There are two native oa, to and one heritage oak tree on t, Vperty. The applicant has <br /> indicated he will be preserving the heritage oak tree but removing the two native oak trees. A <br /> native oak tree may be removed subject to an approved Improvement Plan. <br /> Trees removed under the provisions of this Section (Development Title Section 9-1505) shall be <br /> replaced subject to the following requirements: <br /> • Replacement stock shall be of healthy commercial nursery stock or acorns, of the species <br /> removed or other approved species, and shall be established and maintained for at least <br /> three (3) years (Development Title Section 9-1505.4[a]). <br /> • Replacement trees shall be planted as near as possible to the location of the removed tree <br /> or in an alternative location acceptable to the Review Authority (Development Title Section <br /> 9-1505.4[b]). <br /> • Replacement stock shall be planted between October 1 and December 31, and no later <br /> than twelve (12) months after the date of tree removal (Development Title Section 9- <br /> 1505.4[c]). <br /> • The number and maintenance of replacement stock shall be as follows: <br /> o Each heritage oak tree that has been removed under the provisions of Section 9- <br /> 1505.3(a) shall be replaced with five (5) trees or acorns, or combination thereof. <br /> o Each native oak tree that has been removed under the provisions of Section 9- <br /> 1505.3(b) shall be replaced with three (3) trees or acorns, or combination thereof. <br /> o The applicant shall be required to show to the satisfaction of the Review Authority <br /> that replacement stock will be planted and maintained in such a manner as to <br /> ensure the survival of said stock at the end of a three (3) year period commencing <br /> from the date of planting. <br /> (Development Title Section 9-1505.4[d]) <br /> • The Review Authority may require, as a Condition of Approval, the applicant to provide a <br /> performance bond or other financial security to replant any replacement tree found not to <br /> be alive at the end of the required three (3) year maintenance period. The applicant may <br /> be required to provide additional security to ensure maintenance of said trees for an <br /> ensuing three (3) year maintenance period (Development Title Section 9-1505.4[e]). <br /> 4. Air/Climate <br /> 4.a. All maneuvering areas for vehicles will be paved to prevent dust and dirt. Referrals were <br /> sent to the San Joaquin Valley Unified Air Pollution Control District (SJVAPCD) and SJVAPCD <br /> sent a letter dated May 7, 2008 stating the project is subject to District Rule 9510. District Rule <br /> 9510 is intended to mitigate a project's impact on air quality through project design elements or by <br /> payment of applicable off-site mitigation fees. <br /> 5. Noise <br /> 5 a. Development Title Table 9-1025.9 Part I lists Religious Assembly as a noise sensitive land <br /> use. The project site lies within the 65 dBL noise contour for North State Route 99 East Frontage <br /> Road. A noise study was conducted by Bollard Acoustical Consultants dated May 22, 2008 and <br /> concluded to satisfy the 45 dBL interior noise exposure limit, the developer shall install sound <br /> transmission class 35 or higher exterior windows and doors at the south and west facing building <br /> facades and mechanical ventilation systems should be included in the design. No exterior noise <br /> mitigation was recommended for this project since there are no proposed outdoor activity areas. <br /> 8. Utilities and Public Service <br /> 8.a.
