Agreement so provides or as otherwise set forth in law and ordi- <br /> %, nance. The COUNTY agrees to grant and implement the Project <br /> Approvals and, if required, to grant other land use and building <br /> approvals including, but not limited to, building permits, parcel <br /> maps, tentative maps, final subdivision maps, lot line adjust- <br /> ments and certificates of occupancy reasonably necessary or <br /> desirable to accomplish the goals, objectives, policies and plans <br /> described herein. These land use and building approvals, <br /> however, may be subject to review by the Airport Land Use <br /> Commission, FAA or other airport regulatory agencies and may be <br /> limited to insure airport compatibility as discussed in Exhibit D. <br /> The aforementioned subsequent discretionary approvals shall <br /> be granted and approved by COU14TY on a timely basis, provided <br /> applications for such approvals are submitted to COUNTY during <br /> the term of this Agreement and provided further that DEVELOPER is <br /> not in default of the terms and conditions of this Agreement. <br /> DEVELOPER'S failure to develop the Project Site shall not result <br /> in liability of DEVELOPER except as provided for in this <br /> Agreement. In the event that COUNTY requires DEVELOPER to <br /> install offsite improvements on land to which neither the <br /> DEVELOPER nor the COUNTY has sufficient title or interest to <br /> install the improvements at the time of conditioning the appro- <br /> val, COUNTY agrees to negotiate or commence proceeding pursuant <br /> to Title 7 (commencing with §1230 .010) of Part 3 of the Code of <br /> Civil Procedure to acquire an interest in the land which will <br /> permit the improvements to be made.
