The <br /> Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are designated <br /> nonattainment to reduce emissions until standards are met. <br /> Based on the information provided, it appears that this project will have a less-than-significant <br /> impact on the ambient air quality. However, the construction phase of this project can generate <br /> emissions from the movement of soil, use of heavy equipment, bulk materials handling, asphalt <br /> paving and other related activities. As a result, this project is subject to District Regulation VIII <br /> (Fugitive Dust Prohibitions). The purpose of Regulation `Jill Is to reduce the amount of fine <br /> particulate matter (PM-10) entrained into the ambient air from man-made sources. Please be <br /> advised that the District's Governing Board approved amendments to Regulation VIII, <br /> Rules 8011-8061 and 8071-8081; respectively, that became effective on October 1, 2004. <br /> Of particular note are amendments to Rule 8021 (see section 6.3.1); the Dust Control Plan <br /> threshold has changed from 40.0 acres to 5.0 or more acres for non- residential sites. If a <br /> non-residential site is 1.0 to less than 10.0 acres, an owner/operator must provide written <br /> notification to the District at least 48 hours prior to his/her intent to begin any <br /> earthmoving activities (see section 6.4.1). The attached Compliance Assistance Bulleting <br /> (CAB) highlights many of the requirements contained within Regulation VIII.
