An encroachment permit shall be required for all work within road right-of-way. (Note: Driveway <br /> encroachment permits are for flatwork only - all vertical features, including but not limited to <br /> fences, walls, private light standards, rocks, landscaping and cobbles are not allowed in the right- <br /> of-way.) (Development Title Sections 9-1145.4 and 9-1145.5) <br /> e. The driveway approach on Ray Road shall be improved in accordance with the requirements of <br /> San Joaquin County Improvement Standards Drawing No. R-17 prior to issuance of the <br /> occupancy permit. (Development Title Section 9-1145.5) <br /> f. The access gate for the driveway on Ray Road shall remain open during all hours of operation. <br /> g. All vehicular parking related to applicant's winery shall be onsite at all times. Parking in the <br /> County and State rights-of-way for all winery related events shall be prohibited. It is the <br /> responsibility of applicant to monitor Ray Road and State Route 12 to ensure compliance with this <br /> requirement. <br /> h. if aRY marketiRg eveRts aFe held foF mere than 150 people, the DepaFtmeRt of PubliG VVGFks <br /> proposed projeGt. The property owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result <br /> in a twenty-five (25) foot wide right-of-way from the centerline of Ray Road to the property line <br /> across the frontage of APN's 055-160-29, 41 & 50. (A fee based on the current fee schedule is <br /> required for processing per Development Title Table 9-240.2 in addition to a copy of the Grant <br /> Deed of the subject property.) (Development Title Section 9-1150.5) <br /> j. The property owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result <br /> in a sixty foot (60') wide right-of-way for the future extension of DeBroggi Road across APN 055- <br /> 160-41. (A fee based on the current fee schedule is required for processing per Development <br /> Title Table 9-240.2 in addition to a copy of the Grant Deed of the subject property.) <br /> (Development Title Section 9-1150.5) (Development Title Section 9-1150.5 <br /> k. For each phase of the project, the developer shall provide drainage facilities and meet the <br /> requirements of San Joaquin County Development Standards. Retention basins shall be fenced <br /> with six (6) foot high chain link fence or equal when the maximum design depth is 18 inches or <br /> more. Required retention basin capacity shall be calculated and submitted along with a drainage <br /> plan for review and approval, prior to release of building permit. (Development Title Section 9- <br /> 1135) <br /> I. The Traffic Impact Mitigation Fee shall be required for each phase of this development. The fee <br /> is due and payable at the time of building permit application for each phase. The fee will be <br /> based on the current schedule at the time of payment. The fee shall be automatically adjusted <br /> July 1 of each year by the Engineering Construction Cost Index as published by the Engineering <br /> News Record. (Resolutions R-00-433) <br /> m. The Regional Transportation Impact Fee shall be required for each phase of this development. <br /> The fee is due and payable at the time of building permit application for each phase. The fee will <br /> be based on the current schedule at the time of payment. (Resolution R-06-38) <br /> n.
