m. CALIFORNIA BUILDING CODE: The following California Building Code and San Joaquin County <br /> Ordinance requirements will be applicable and shall be incorporated in the construction plans before <br /> submittal to the Building Inspection Division: <br /> (1) The proposed use will change the occupancy from U-3 occupancy to M occupancy (UBC <br /> Section 3405). The structure shall be brought into compliance with all current code provisions <br /> including structural, plumbing, mechanical, electrical, energy and disabled access requirements. <br /> A licensed architect or registered engineer shall prepare all documents. <br /> (2) Provide restrooms conforming with all disabled access requirements (C.C.R., Title 24) Uniform <br /> Plumbing Code, Table 4-1. <br /> (3) Provide identification signs for parking space(s) including the "tow away" sign at each entrance <br /> or visible from each space. (C. C. R., Title 24). <br /> (4) The slope of the parking space shall not exceed '/4 inch per foot (C. C. R., Title 24). <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack. set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> 3. ENVIRONMENTAL HEALTH DEPARTMENT(Staff Contact: David Van Dyne, 468-3453) <br /> a. The Environmental Health Department requires a soil suitability/nitrate loading study, incorporating <br /> proposed staff and customer use, indicating that the area is suitable for septic tank usage. This must <br /> be performed prior to issuance of building permits (Development Title Section 9-1105.2[d]). A review <br /> fee of$465.00 must be paid at the time of submittal to the Environmental Health Department. <br /> The sewage disposal system shall comply with the on-site sewage standards of San Joaquin County <br /> prior to approval. A percolation test that meets absorption rates of the manual of septic tank practice <br /> or the EPA Design Manual for on-site waste water treatment and disposal systems is required for <br /> each parcel. A permit fee of$93.00 per percolation hole is required. <br /> b. The existing private water wells shall be tested for the chemical Dibromochloropropane (DBCP) and <br /> nitrates prior to issuance of building permits. Samples are to be taken and analyzed by a State <br /> approved laboratory (Development Title Section 9-1115.7). <br /> c. Construction of individual sewage disposal systems under permit and inspection by the <br /> Environmental Health Department is required at the time of development based on the Soil <br /> Suitability/Nitrate Loading Study findings (Development Title Sections 9-1110.3 and 9-1110.4). <br /> d. Should the number of non-resident individuals exceed 24 for at least 60 days per year, or the number <br /> of service connections exceed four, a yearly permit to operate a public water system will be required <br /> by the Environmental Health Department(Development Title Sections 9-1120.2 and 9-1115.9) <br /> Conditions of Approval - 3 - PA-0500470 <br />
