Prior to the release of the Draft EIR, San Joaquin County(Lead Agency) issued a Notice of Preparation (NOP) <br /> for a 30-day comment period between January 26, 2011 and February 27, 2011. The environmental issues <br /> raised during the scoping process were considered in the Draft EIR. The Draft EIR for the Munn & Perkins <br /> Quarry Excavation Permit was submitted to the State Clearinghouse (SCH#2005082001) on May 9, 2011. A <br /> second public notice was issued on July 11, 2011. The public review and comment period for the Draft EIR <br /> concluded on August 22, 2011. All other oral and written comments received during the 45-day review period for <br /> the Draft EIR have also been responded to and included in the Final EIR. Where necessary, the text of the draft <br /> document has been amended as a result of the public review process. Final EIRs and/or notices of availability <br /> were mailed and e-mailed to interested persons, organizations, and local agencies on October 27, 2011. Final <br /> EIR's were distributed to the Planning Commission on October 27, 2011. <br /> DETERMINATION OF ADEQUACY OF THE FINAL ENVIRONMENTAL IMPACT REPORT: <br /> The only determination to be made by the Commission in order to certify the EIR is whether or not it is adequate <br /> as described in Section 15151 of the CEQA Guidelines. This section states in part "an EIR should be prepared <br /> with a sufficient degree of analysis to provide decision makers with information which enables them to make a <br /> decision which intelligently takes account of environmental consequences. An evaluation of the environmental <br /> effects of a proposed project need not be exhaustive, but the sufficiency of an EIR is to be reviewed in light of <br /> what is reasonably feasible." <br /> It is the Community Development Department's determination that the EIR meets the intent of this section. The <br /> document thoroughly discusses all potentially significant environmental issues, contains all sections required by <br /> law, and adheres to all review periods and time requirements. All issues raised during the review of the draft <br /> document are thoroughly discussed in the Final EIR. <br /> Recommendation <br /> Certification of EIR.
