The number <br /> of extended nights will not exceed 125 nights per year provided there are no unexpected delays in <br /> construction work.Nighttime work will be limited to the asphalt batch plant,loaders,trucks including <br /> a water truck, and scale house.Excavation activities and the crushing of rock will not be permitted <br /> during the expanded nighttime hours of 9:00 p.m.to 5:00 a.m. The Revisions of Approved Actions <br /> request will not remove any of the existing other previously approved conditions of approval <br /> including the Reclamation Plan. <br /> An Initial Study/Mitigated Negative Declaration(IS/MND)was originally prepared for the proposed <br /> project;however the applicant voluntarily pulled the MND from consideration when numerous <br /> comments were received from neighboring properties expressing concern over the potential for <br /> noise from night time operations,odor from the asphalt batch plant,and dust generation from existing <br /> operations.Due to the issues raised after release of the MND,it was determined that an Environmental <br /> Impact Report(EIR)should be prepared for the proposed Munn&Perkins Quarry Project. <br /> 1 .3 Type of Environmental Impact Report <br /> The CEQA Guidelines identify several types of E1Rs, each applicable to different project <br /> circumstances. This EIR is prepared as a project-level EIR pursuant to CEQA Guidelines <br /> Section 15161. This type of EIR focuses primarily on the changes in the environment that <br /> would occur as a result of project development, and examines all phases of a particular project <br /> (i.e.,planning, construction, operation). Therefore,this EIR focuses on the direct and reasonably <br /> foreseeable indirect changes in the environment resulting from a change in operational hours. <br /> 1 .4 Use of this Environmental Impact Report <br /> The EIR will be used by San Joaquin County as a tool to evaluate the proposed project's environmental <br /> impacts.The EIR will be reviewed and considered by the decision making body,in this instance the <br /> County Planning Commission, in its decision to approve or deny the proposed project. <br /> A Responsible Agency complies with CEQA by considering the EIR or Negative Declaration <br /> prepared by the Lead Agency and by reaching its own conclusions on whether and how to <br /> approve the project involved. <br /> 1.5 CEQA Environmental Impact Report Process <br /> 1.5.1 Notice of Preparation <br /> In accordance with CEQA Guidelines Section 15082,the County circulated a Notice of Preparation <br /> (NOP) for this EIR on January 26, 2011, for a 30-day public review period that concluded on <br /> February 27,2011.The NOP was circulated to the public,interested parties,and local, state,and <br /> Munn&Perkins Quarry Excavation Permit 1-2 ESA 1211086 <br /> Draft EIR - April 2011 <br />
