CHAPTER 1 <br /> Introduction <br /> 1 .1 Overview <br /> This Environmental Impact Report (FIR) for the Munn & Perkins Quarry Excavation Permit <br /> (proposed project) (SCH#2005082001) Nvas prepared in compliance with the California <br /> Fnvironriiental Qualitv Act (CEQA)and CEQA Guidelines (California Code of Re,ulations, <br /> Title 14). San Joaquin County is the lead agency for the environmental revieat of the proposed <br /> project and has the principal responsibility for approving the project. As described ill the CEQA <br /> Guidelines Section 1 5121(a). an ETR is a public information document that assesses potential <br /> environmental effects ofa proposed project, as well as identifies mitigation rlleasU.res and <br /> alternative's to the project that could reduce or avoid adverse erlVlr'1011111eTltal impacts. CEQA <br /> reCjuireS that state and local government agencies consider the environmental Qon.segUeWeS Of <br /> projects over which they have discretionary atithority. The EIR is an informational document used <br /> in the planning and decision-making process. It is not the purpose of an EIR to recommend either <br /> Approval or denial of a project. <br /> The procedures required by CEQA "are intended to assist public agencies in systematically identifying <br /> both the sionifcant effects of proposed projects and the feasible alternatives or fcasible mitigation <br /> measures which XX ill avoid or SUbstantially lessen such sit=nificant effects (Public Resources Code <br /> Section 21002)." As a genera rule, "public agencies should not approve projects as proposed if <br /> there are feasible alternatives or feasible mitigation measures available which would substantially <br /> lessen the siunificant environmental effects of such projects." However,-In the event specific economic, <br /> social, or other conditions make infeasible such project alternatives or such mitigation pleasures. <br /> individual projects may be approved in spite ofone Or ruor•e significant effects thereof(11W.).• <br /> Stated diffierently_ under CEQA,a lead agency nlust make certain determinations before it can approve <br /> or carry out a project if the EIR reveals that the project will result in one or more significant <br /> environmental impacts. <br /> 'fhe lead agency must "certify" the Ilincl EIR. According to the "CEQA Citiideliiies," "cei-tificatioii" <br /> consists of three separate steps. Prior to approving a project, the lead agencyshall certify that (I} <br /> the Final EIR has been completed in compliance with CEQA; (2) the Final ETR was presented to <br /> the decision-Making body of the lead agency and that the body- has reviel,ied and considered the <br /> information contained in the Final FIR prior to approving the project-, and (3)the Final FIR reflects <br /> the lead agency's independent jUdgmerlt and analysis (CEQA Guidelines, Section 15090(x), see <br /> also Public Resources Code, Section 21082.1(c)(3)). <br /> ...............---------—-— -- ------.....--........................ .. .. .............. . .. ...........................-...........................-... <br /> - <br /> ....-..
