Removal and storage of topsoil must be clarified. The plan indicates that topsoil <br /> will be stripped and set aside temporarily but there is no indication of the length <br /> of time that the soil will be stored or where it will be placed. Topsoil storage <br /> areas must be shown on a site map (CCR 3711(b)) and prime agricultural soil <br /> must be separated and replaced after mining by soil horizon (CCR 3707(b)). <br /> 7. Since the project intends to mine lands under Williamson Act Contract, the <br /> project must be reclaimed to prime agricultural land pursuant to the standards set <br /> forth in § 3707. Mining operations on prime agricultural lands, as defined by the <br /> U.S. Soil Conservation Service, must be returned to a fertility level as specified in <br /> the approved reclamation plan (3707(a)). <br /> Administrative Requirements <br /> (Refer to SMARA Sections 2772(c)(10), 2773.1, 2774(b), 2776, 2777, PRC Section 21151.7) <br /> 8. The reclamation plan does not contain an applicant statement accepting <br /> responsibility for reclamation per the reclamation plan (SMARA 2772(c)(10).
