(6) In any instance that the County or State makes the demand for partial or full tender of the <br /> financial guarantee of performance, the County and/or State may use all or any portion of the <br /> financial guarantee to reclaim the site and to recover its administrative costs associated <br /> therewith. (Development Title Section 9-1415.3[r]) <br /> p. ENFORCEMENT: Except as otherwise provided in State Mining Regulations, the County shall have <br /> authority to enforce provisions of the Surface Mining and Reclamation Act. The County may <br /> exercise all enforcement regulations available under the County Development Title and the State <br /> Public Resources Code. Such enforcement measures include charging the applicant the costs of <br /> administering an enforcement action. The basis for charging fees for an enforcement action shall be <br /> a time and materials compensation. (Development Title Section 9-1415.3[t]) <br /> q GROUNDWATER CONDITIONS: Excavation below groundwater level is not permitted. <br /> r NOISE: The operator shall implement the following measures to reduce the impact of <br /> construction related noise: <br /> (1) All existing and future residences shall have adequate (approximately eight feet tall with 2:1 <br /> slope) berm placement to prevent line of sight to the quarry. Line of sight graphics shall be <br /> included with the Improvement Plan. <br /> s RECLAMATION: The site shall be reclaimed to an agricultural use. <br /> L MERGER: The site consists of four separate parcels. The parcels shall be merger prior to <br /> initiation of the use of the site as a quarry. <br /> 2 DEPARTMENT OF PUBLIC WORKS (Staff Contact: Alex Chetley, 468-3000) <br /> a. The excavation plan shall be prepared by a registered civil engineer or land surveyor and include <br /> the following: <br /> (1) Detail of access road (first 100 feet from Harrold Avenue shall be paved). <br /> (2) A plan of the haul route for County roads. <br /> (3) Stockpile area for top soil (no excavation or stockpile shall be allowed within 25 feet of the <br /> property boundary or the County right-of-way). <br /> (4) Public roads shall be kept free from mud, dirt, and gravel resulting from quarry operations. <br /> b All private roads involved in the excavation shall be maintained to control dust. <br /> c A video tape shall be made of the planned haul route showing conditions of all County roads <br /> The condition of San Joaquin County maintained roads along the haul route shall be reviewed <br /> with the Department of Public Works prior to the start of excavation. (Development Title Section <br /> 9-1415.2) <br /> d. Loads on all public roads shall be required to be legal loads only. (Street and Highway Title <br /> Section 10-2350) <br /> e. An encroachment permit shall be required for work within the road right-of-way. (Development <br /> Title Sections 9-1145.4 and 9-1145.5) <br /> f. A cash deposit or security in the amount and forth acceptable to the Department of Public Works <br /> shall be filed with the Department with a guarantee that if the permittee fails, refuses, or neglects <br /> to repair, under permit, any damages to any County roads along the haul route which may result <br />
