Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Major Subdivision Application No. PA-0700055 with the Findings and Conditions of <br /> Approval contained in the staff report. <br /> Findings <br /> 1 The proposed subdivision is consistent with the General Plan, any applicable Master Plan, Specific <br /> Plan, and Special Purpose Plan and any other applicable plan adopted by the County. <br /> • This finding can be made because the R/L (Low Density Residential) General Plan <br /> designation and R-L (Low Density Residential) zone permit the subdivision as proposed. <br /> The project complies with the General Plan density requirements for the R-L zone (2-6 <br /> dwelling units/gross acre). There are no applicable Master Plans, or Specific Plans, or <br /> Special Purpose Plans. <br /> 2 The design or improvement of the proposed subdivision is consistent with the General Plan and any <br /> applicable Specific Plan or Special Purpose Plan. <br /> • This finding can be made because the design and improvements of the proposed <br /> subdivision are consistent with the standards contained in the General Plan as reflected <br /> on the Vesting Tentative Map. The Department of Public Works has provided the applicant <br /> "will-serve" letters stating sanitary sewer services and storm drainage services can be <br /> provided to the proposed subdivision. California Water Service has provided a "will-serve" <br /> letter stating water service can be provided to the proposed subdivision. There are no <br /> applicable Specific Plans or Special Purpose Plans. <br /> 3 The site is physically suitable for the type of development proposed. <br /> • This finding can be made because the parcels' lot size and width all satisfy the minimum <br /> lot size and width requirements for parcels in the R-L zone. In addition, the lots are <br /> relatively level. <br /> 4 The site is physically suitable for the proposed density of development <br /> • This finding can be made because the Vesting Tentative Map indicating seven (7) <br /> residential lots is consistent with the General Plan density requirements of 2-6 dwelling <br /> units per gross acre in the R/L General Plan designation. The parcels are suitable for the <br /> proposed public sewer services, public water services, and public stormwater services. <br /> 5 Neither the design of the subdivision nor any proposed improvements are likely to cause substantial <br /> environmental damage or substantially and avoidably injure fish or wildlife or their habitat <br /> • This finding can be made because the Initial Study prepared for this project did not <br /> identify any known rare or endangered species or habitats or other substantial <br /> San Joaquin County PA-0700055\Hacketl <br /> Community Development page 5 —1/ <br />
