COTTA, JR. and MARIE A. COTTA ("Landlord"), and LEEN <br /> DeSNAYER and PAULA DeSNAYER ("Tenant"). Landlord hereby leases to Tenant <br /> that certain real property located in the County of San Joaquin, State of California, <br /> consisting of approximately 180 acres, more or less, as more particularly described in <br /> Exhibit "A" attached hereto and made a part hereof("the Premises"). <br /> TERM <br /> 1. This Lease shall commence on December 1, 2003 and shall terminate on <br /> November 30, 2008. <br /> RENT: LATE CHARGE <br /> 2. Commencing on December 1, 2003 and on the first day of each month <br /> thereafter during the remainder of the initial lease term, Tenant agrees to pay to Landlord <br /> as rent for the use and occupancy of the Premises monthly rent in the amount of <br /> $2.250.00 per month ("the Monthly Rent"). <br /> 1 JSE OF THE PREMISES <br /> 3. The Premises are leased for the purpose of Tenant planting and growing <br /> _ thereon and harvesting therefrom forage and row crops and related agricultural activities. <br /> The corrals located on the Premises shall be used for the purpose of feeding dairy cattle. <br /> IRRIGATION AND DRAINAGE <br /> 4. Tenant shall use the water and any water rights appurtenant to the Premises in <br /> accordance with the rules and limitations applicable thereto. Landlord makes no <br /> representations, warranties, or guarantees with reference to the quality or quantity of <br /> irrigation water made available. Landlord shall be responsible for the payment of any and <br /> all standby or services charged levied by the Woodbridge Irrigation District. or its <br /> respective successor. Tenant shall be responsible for the payment of all water tolls <br /> charged for water contracted for use on the Premises. Tenant shall, at his sole cost and <br /> expense, keep clean and maintain any and all private irrigation and drainage ditches <br />
