Facts in Support of Findings <br /> Short-term air quality impacts during construction will be less than significant with implementation of <br /> Mitigation Measures AIR-la, AIR-lb, AIR-lc, AIR-Id, AIR-le, AIR-lf, AIR-1g, AIR-1h, AIR-li, AIR-lj, <br /> AIR-lk, AIR-11, and AIR-lm, which require the utilization of standard construction measures to control <br /> construction-related emissions, including fugitive dust emissions. Air quality impacts arising from project <br /> operations will be less than significant with implementation of Mitigation Measures AIR-2a,AIR-2b,AIR-2c, <br /> AIR-2d, and AIR-2e,which require the incorporation of measures to reduce criteria pollutant emissions from <br /> project operations,including, all facility switch locomotives shall meet Tier 0 Plus emission levels by 2021,the <br /> facility shall implement an anti-idling policy at the facility that generally limits non-necessary idling of cargo- <br /> handling equipment to five minutes or less, the facility shall install an automatic gate system (AGS), one <br /> hundred percent of Direct-to-Locomotive (DTL) refueling performed at the facility shall be with diesel fuel <br /> meeting CARB's specification for on-highway diesel (ie., with CARB diesel), and the facility shall install <br /> electrical.infrastructure (i.e. "a reefer rack" to support the operation of one hundred percent of the expected <br /> container TRUs on electrical power while being stored at the facility. <br /> Impacts from tonic air contaminants (DPM) will be less than significant with implementation of Mitigation <br /> Measure AIR-3, which in tum requires the implementation of Mitigation Measures AIR-2a,AIR-2b,AIR-2c, <br /> AIR-2d, and AIR-2e to reduce both criteria pollutant and DPM emissions. Finally, cumulative au quality <br /> impacts from criteria pollutant emissions and toxic air contaminants (DPM) from the project will be less than <br /> significant with implementation of Mitigation Measure AIR-4, which in tum requires the implementation of <br /> Mitigation Measures AIR-2a,AIR-2b,AIR-2c,AIR-2d, and AIR-2e to reduce both criteria pollutant and DPM <br /> emissions. <br /> 4.1.3 Aesthetics <br /> Summary of Potential Impacts <br /> An evaluation of potential impacts from the project on visual aesthetics is found in Section 4.5 (Aesthetics) <br /> of the Draft EIR. <br /> Lighting for the project would be provided by high mast lighting on freestanding poles, with varied <br /> illumination levels depending on operational, security, and safety requirements. No residences are located in <br /> the immediate vicinity of the site and thus lighting impacts would be experienced by more distant residential <br /> areas such as the Del Webb neighborhood. Most of the homes in this area are one story and located behind <br /> solid walls that line Airport Way. This fact, combined with the distance from the site, would reduce <br /> significant light and glaze from the expanded operations for residences,as lights would not shine directly into <br /> residential windows. However, operations at the site would occur 24-hours per day and 365 days per year. <br /> Thus, lighting at the facility would occur during all hours of darkness and would change the existing <br /> agricultural ambience of the site. Cumulative projects,in conjunction with the project,would also change the <br /> overall character of the area surrounding the project site and would substantially degrade the existing visual <br /> character or quality of the site and its surroundings by replacing wide expanses of undeveloped agricultural <br /> lands with new development. <br /> Findings <br /> The County finds that, pursuant to Section 15091(a)(1) of the CEQA Guidelines, changes or alterations <br /> have been required in or incorporated into the project,which mitigate or avoid potential impacts to aesthetics <br /> by light and glare from the project as identified in the Final EIR. The County further finds that the change or <br /> alteration in the project or the requirement to impose the mitigation as a condition of project approval is <br /> within the jurisdiction of the County to require,and that this mitigation is appropriate and feasible. <br /> November 2012 7 Findings of Fact/ <br /> Statement of Overriding Considerations <br />
