Facts in Support of Findings <br /> Impacts to aesthetics from light and glare from project operations will be less than significant with <br /> implementation of Mitigation Measure AESTHETICS-1, which requires that all lighting shall be effectively <br /> shielded to prevent spillage beyond the area requiring lighting for safety and operational purposes.Further,no <br /> lighting shall be directed off the site or placed directionally so that lighting would shine outwards during <br /> project operations,and any off-site lighting at nearby parcels shall be less than one-foot candle at the most. <br /> With implementation of Mitigation Measure AESTHETICS-2, which in turn requires the implementation <br /> of Mitigation Measure AESTHETICS-1, the project's incremental contribution to cumulative aesthetic <br /> impacts would be less than significant as the recommended measures would help screen project <br /> development and would reduce the potential for significant light and glare. <br /> 4.1.4 Biological Resources <br /> Summary of Potential Impacts <br /> An evaluation of potential impacts to biological resources is found in Section 4.6 (Biological Resources) of the <br /> Draft EIR. <br /> The proposed project may have a substantial adverse effect, either directly or through habitat modifications, <br /> on special-status wildlife species. Special-status animals that are presumed present or that may forage within <br /> the boundaries of the project site include the state-listed species Swainson's hawk,California species of special <br /> concern northern harrier, burrowing owl, and western red bat; and the California Fully Protected species <br /> white-tailed kite. The project would result in the conversion of approximately 154 acres of agricultural lands, <br /> including row/field crops and orchards, which could provide suitable foraging habitat for such special-status <br /> wildlife species. The project will also result in the fill of wetlands and/or waters of the U.S./State, namely, <br /> DC-1 and the French Camp Outlet Canal C FCOC') and their associated in stream wetlands. DC-1 and the <br /> FCOC are drainage canals managed by the South San Joaquin Irrigation District C SSJID') and eventually drain <br /> into French Camp Slough,which drains into the San Joaquin River north and eventually the bay. Specifically, <br /> the applicant proposes to place DC-1 inside a culvert and to pave over it through the project site. The new <br /> culvert would not restrict flow in DC-1. The culvert for DC-1 would be approximately 1,307 feet long and <br /> would impact at least 1,254 linear feet of jurisdictional waters not currently culverted. The applicant also <br /> proposes to place FCOC inside two sections of culvert in order to cross over these areas with spur track The <br /> culverts that would contain sections of FCOC would be approximately 344 and 618 feet long. The project <br /> would also contribute to cumulative impacts on special-status wildlife species when combined with other <br /> projects in the area. <br /> Findings <br /> The County finds that, pursuant to Section 15091(a)(1) of the CEQA Guidelines, changes or alterations <br /> have been required in or incorporated into the project, which mitigate or avoid potential impacts to special- <br /> status wildlife species and wetlands and/or waters of the U.S./State as identified in the Final EIR.The County <br /> further finds that the change or alteration in the project or the requirement to impose the mitigation as a <br /> condition of project approval is within the jurisdiction of the County to require, and that this mitigation is <br /> appropriate and feasible. <br /> v <br /> Findings of Fact/ 8 November 2012 <br /> Statement of Overriding Considerations <br />
