s.Mitigation Monitoring and Reporting Program <br /> ATTACHMENT C <br /> MITIGATION MONITORING AND REPORTING PROGRAM <br /> UNION PACIFIC EXPANSION AND MODERNIZATION PROJECT <br /> Responsible Mitigation Measures and Statements of Findings of Impacts Being Monitoring/ RespMonitoring/Reporting <br /> Significant and Unavoidable Reporting Action Party for Providing Responsibility Timing <br /> Mitigation <br /> 4.1 Land Use and Agricultural Resources <br /> LANDA:To mitigate the conversion of Important Farmland for the project,the Verification by County. Union Pacific San Joaquin County Prior to project construction <br /> project sponsor shall either dedicate or acquire a conservation easement which Community Development activities <br /> preserves farmland or pay in lieu fees for the acquisition of such an easement.A Department and San <br /> conservation easement is an encumbrance sometimes including a transfer of Joaquin Council of <br /> usage rights(easement)which creates a legally enforceable land preservation Governments if participation <br /> agreement between a landowner and a government agency(municipality,county, is sought in the SJMSCP <br /> state,federal)or a qualified land protection organization(often called a"land <br /> trust"),for the purposes of conservation. It restricts real estate development, <br /> commercial and industrial uses,and certain other activities on the property.This <br /> mitigation strategy would ensure that the acquisition of the conservation <br /> easement land achieves maximum benefits for the residents of San Joaquin <br /> County and other public or private land conservation programs.The number of <br /> acres of agricultural land subject to a conservation easement shall be equal to the <br /> number of acres of Important Farmland that would be changed to a non- <br /> agricultural use by the proposed project[a 1:1 ratio]and of equal or better quality <br /> as the Important Farmland converted by the project.Final approval of the <br /> proposed project shall be contingent upon the execution of the legal instrument to <br /> create a conservation easement as described herein or payment of an in-lieu fee <br /> to a government agency or qualified land protection organization/land trust, <br /> including SJCOG Inc.under the San Joaquin Multiple Species Conservation <br /> Program(SJMSCP),for the acquisition of such an easement within San Joaquin <br /> County.A conservation easement which preserves farmland may be combined <br /> with a conservation easement which also preserves habitat for biological <br /> resources,including under the SJMSCP,provided the easement preserves <br /> farmland of equal quantity and quality as the Important Farmland converted by <br /> the project. <br /> Less than significant impact after implementation of Mitigation Measure <br /> LAND-1. <br /> LAND-2:Less than significant impact after implementation of Mitigation Verification by County.
