Regulations shall include the County's General Plan, the Development Title, and the County's <br /> Building and Fire Codes. <br /> 1.1.29. Legal Requirements. All decisions, statutes, laws, constitutions, <br /> ordinances, rulings, directions, rules, regulations, orders, writs, decrees, injunctions, permits, <br /> certificates or other requirements of any Governmental Entities (unless specified otherwise) in <br /> any way applicable to or otherwise affecting the Property, including any of the foregoing made <br /> applicable to the Property pursuant to this Agreement. <br /> 1.1.30. Mortgage. A mortgage, deed of trust, or similar security instrument or <br /> transaction in which the Property, or a portion thereof or an interest therein, is pledged as <br /> security, contracted for in good faith and for fair value in connection with the acquisition, <br /> development and use of the Property. <br /> 1.1.31. Mortgagee. The holder of the beneficial interest under a Mortgage, or the <br /> owner of the Property, or interest therein, under a Mortgage. <br /> 1.1.32. Other Governmental Entity, Other Governmental Entities. Any <br /> Governmental Entity or Governmental Entities other than the County and having jurisdiction <br /> over the Property or any aspect or part thereof. <br /> 1.1.33. Parties. County and Developer, and any subsequent Recognized Assignee <br /> as to its interest in the Property or portion thereof. <br /> 1.1.34. Pte. Either County or Developer, or any Recognized Assignee as to its <br /> interest in the Property or portion thereof. <br /> 1.1.35. Permitted Assignment. A sale, assignment or transfer consented to by <br /> County pursuant to, or satisfying the other applicable requirements of,the provisions of Section <br /> 1.5.2. or 1.5.3. hereof. <br /> 1.1.36. Person (s). Any person, firm, association, organization, partnership, trust, <br /> corporation or company or combination of the foregoing. <br /> 1.1.37. Planning Commission. The Planning Commission of the County, or any <br /> successor thereto. <br /> 1.1.38. Property. The real property illustrated in Exhibit A-1 and described in <br /> Exhibit A-2 hereto and any other real property added to this Agreement by recorded amendment <br /> pursuant to Section 1.8.7. hereof. <br /> 1.1.39. Recognized Assignee. Any successor in interest to Developer with respect <br /> to the Property or any portion thereof permitted under and complying with the provisions of <br /> Section 1.5. hereof. <br /> 1.1.40. Regional Transportation Impact Fee (RTIF). Resolution R-06-38 adopted <br /> on January 7, 2006 by the County Board of Supervisors requiring all new development in the <br /> unincorporated areas of San Joaquin County to participate in the RTIF. <br /> -10- <br />
