The short term improvements identified in the PSR should <br /> be constructed prior to building occupancy. However, it <br /> is estimated that it may require a lengthy period of time <br /> (approximately 21 months) for Caltrans to review and <br /> approve the PSR and related environmental documents. As <br /> a condition of this agreement, Bay Cities and other <br /> developers may post a security bond for an amount equal <br /> to the estimated cost of the improvements identified in <br /> the . draft PSR, in order to secure an occupancy permit <br /> ' from the County. <br /> For any Caltrans facilities which have not yet been <br /> completed, prior to building occupancy the developers <br /> shall have completed the design and improvement plans, <br /> have obtained initial approval of the configuration from <br /> Caltrans, and have entered into a secured improvement <br /> agreement with the County, in an amount and form <br /> acceptable to the County Public Works Department and <br /> County Counsel. <br /> The developer shall post a security bond or other <br /> acceptable security with the County equal to the <br /> estimated' cost, plus a loo contingency, of the <br /> improvements identified in the draft or adopted Project <br /> Study Report, or otherwise required by Caltrans. <br /> Security shall include the full estimated cost of the <br /> improvements required by Caltrans, including any <br /> estimated cost of right-of-way acquisition which has not <br /> yet been obtained. <br /> 9. CALIFORNIA DEPARTMENT OF FISH AND GAME and U. S. FISH AND <br /> WILDLIFE SERVICE: <br /> Kit Fox Mitigation Program <br /> a. As requested by the Department of Fish and Game in their <br /> letter of April 6, 1990, Bay Cities shall pay their fair <br /> share of $200, 000 to the State of California (or to the <br /> County of San Joaquin, acting as project manager for the <br /> study) to cover the costs of conducting a survey and <br /> preparing a Habitat Conservation Plan for the San Joaquin <br /> kit fox for western San Joaquin County. The amount of Bay <br /> Cities ' contribution shall be settled between Bay Cities <br /> and the developer of the Gateway Business Park and the <br /> Safeway projects. <br />
