Analysis <br /> Background <br /> A group care home of 6 or fewer residents is permitted in the R-L zone with an approved business <br /> license. The applicant has an approved business license (No. BL-0700172) which is approved for a <br /> maximum of 6 residents. The group care facility is currently conducted within an existing 3,720 square <br /> foot single family residence. A group care facility of seven or more people requires a conditionally <br /> approved Use Permit in the R-L zone. On April 3, 2008, the applicant applied for Use Permit No. PA- <br /> 0800122 for the expansion of an existing group home for up to 24 residents. However, due to the existing <br /> sewer capacity rated for the existing single family residence, the applicant has since revised the project <br /> description by reducing the proposed number of residents at the group home down to 16. The proposed <br /> expansion from 6 residents to 16 residents will utilize the existing dwelling; there is no further expansion <br /> of the dwelling currently being proposed. The group home will employ up to three people of which two will <br /> reside on the premises. The proposed number of approved residents (16) within the group home includes <br /> the employees who reside there. <br /> Public Service Access <br /> Development Title Section 9-1030.3(f) states that the applicant must develop and implement a public <br /> service access plan providing or arranging for transportation, as necessary, for group care residents. The <br /> plan must specifically describe the means by which residents will gain access to bus and other public <br /> transportation routes, shopping locations, medical, dental, or other health care facilities, and government <br /> offices. This plan must be approved by the Community Development Department prior to issuance of a <br /> building permit or establishment of the use. <br /> Outdoor Recreation Area <br /> Development Title Section 9-1030.3(a) states that an exterior yard area is a requirement for a social care <br /> facility. The exterior yard area must consist of an outdoor recreation area. (Development Title Section 9- <br /> 1030.3[b])The outdoor recreation area must be a minimum of seventy-five (75) square feet per user over <br /> two (2) years of age. With the project proposing up to 16 residents, of which two will be employees, the <br /> requirement for an outdoor recreation area would be 1,050 square feet. The existing rear yard area <br /> consists of 10,000 square feet and will be used as the required outdoor recreation area. Furthermore, <br /> outdoor activities will be limited to the hours of 7 a.m. to 10 p.m. <br /> All outdoor recreation areas must be enclosed by walls or fences not less than six (6) feet in height. <br /> (Development Title Section 9-1030.3[c]) The outdoor recreation area is currently fenced with a six-foot <br /> high solid wooden fence and therefore meets the fencing requirement. <br /> Opposition <br /> The Community Development Department has received one letter of opposition from the City of Stockton <br /> Community Development Department. The letter stated that the location of the proposed project is not <br /> compatible with the Stockton Municipal Code. However, the group care home is consistent with the <br /> requirements, regulations and polices of the Development Title regarding both the R-L (Low Density <br /> Residential) zone and large group care homes. A letter was also received from the San Joaquin County <br /> Sheriff expressing concern regarding the impact on their patrols due to the size of the project and the <br /> anticipated potential complaints from surrounding neighbors. <br /> San Joaquin County PA-0800122/Ferrell <br /> Community Development Page 3 <br />
