Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-0800122 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the residential use type Group Care- Large may be <br /> conditionally permitted in the R-L zone (Low Density Residential) with an approved Use <br /> Permit application. The R-L zone is an implementation zone of the R/L General Plan <br /> designation. The project site has a General Plan designation of R/L (Low Density <br /> Residential), is within a residentially developed area and is located within the urban <br /> community of Stockton. There are no applicable Master Plans, Specific Plan, Special <br /> Purpose Plans, or any other applicable plans which are within the vicinity of this project. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> _ proposed roadways. <br /> • This finding can be made because the Department of Public Works has determined that the <br /> proposed project does significantly impact the existing connection to the public sewer <br /> service provided by East Stockton SSP. The parcel will continue to be served by California <br /> Water for public water. The Department of Public Works is requiring the applicant to make <br /> frontage improvements to the parcel by installing a sidewalk along Section Avenue. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 0.38 acre parcel is of adequate size and shape to <br /> accommodate the group care facility and all yards, building coverage, setbacks and other <br /> requirements of the Development Title. The group care home will utilize the existing single <br /> family dwelling. The existing dwelling is of adequate size to accommodate the proposed <br /> number of residents. The lot size is adequate to accommodate the required outdoor <br /> recreation areas. <br /> Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> \ injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the Initial Study prepared for the project found no <br /> potentially significant environmental impacts. <br /> San Joaquin County PA-0800122/Ferrell <br /> Community Development Page 4 <br />
