h. ATTIRE: In any establishment where the sale of alcoholic beverages is lawfully permitted, it is <br /> unlawful for any Responsible Person to allow any person to remain on the premises while such <br /> person is unclothed, or in such attire, costume, clothing or semi-transparent covering as to <br /> expose to view any portion of the female breast below the top of the areola or any portion of the <br /> pubic hair, anus, buttocks, vulva or genitals. (Development Title Section 9-1085.16) <br /> i. DISTURBING THE PEACE—DISORDERLY CONDUCT: Each Responsible Person shall make <br /> Reasonable Efforts to prevent the admittance of any person whose conduct is described in Penal <br /> Code Section 415 (fighting, loud noise, offensive words in public places) or 647 (disorderly <br /> conduct) at the premises or on any parking lot or similar facility used by the establishment. Each <br /> Responsible Person shall make Reasonable Efforts to remove any persons exhibiting such <br /> conduct from the establishment. (Development Title Section 9-1085.9) <br /> j. INTOXICATED CUSTOMERS: Each Responsible Person shall make Reasonable Efforts to <br /> prevent the admittance of any obviously intoxicated person. For purposes of this section, a <br /> person is "obviously intoxicated" when he or she exhibits readily apparent outward manifestations <br /> of drug or alcohol intoxication, including but not limited to, inability to walk or stand in a normal <br /> manner, bloodshot or glassy eyes, flushed face, incoherent or slurred speech, alcoholic breath, <br /> belligerence or other loud or boisterous conduct, extreme agitation or nervousness or mental <br /> confusion. (Development Title Section 9-1085.10) <br /> k. DISORDERLY CONDUCT WITHIN FIFTY (50) FEET PROHIBITED: Each Responsible Person <br /> shall make Reasonable Efforts to control the conduct of patrons so as to prevent or minimize <br /> disorderly or untawful conduct within the establishment and within fifty (50)feet of the <br /> establishment. DISPLAY OF PERMITS: The permit issued pursuant to this chapter shall at all times be <br /> displayed in a conspicuous place in the entertainment establishment for which it was issued and <br /> shall be immediately produced upon the request of any law enforcement or code enforcement <br /> officer. (Development Title Section 9-1085.22) <br /> 2. SHERIFFS DEPARTMENTS (Staff Contact: Lt. Tom Desmarais, 468-4150) <br /> a. Live Entertainment, including but not limited to D.J., Band, Dancing, or Competitions: occurring <br /> Monday through Thursday will ensure a minimum of 3 uniformed security personnel who shall be <br /> hired for the sole purpose of providing security, one of which will be responsible at the location of <br /> the entrance to check identification. Any live entertainment on the patio shall require 2 additional <br /> uniformed security personnel, for a total of 5 security officers. <br /> b. Live Entertainment, including but not limited to D.J., Band, Dancing, or Competitions: Occurring <br /> on Friday, Saturday and/or Sunday, will ensure a minimum of 4 uniformed security personnel who <br /> shall be hired for the sole purpose of providing security, two of which will be responsible at the <br /> location of the entrance to check identification. Any live entertainment on the patio shall require 2 <br /> additional uniformed security personnel. for a total of 6 security officers. <br /> c. Live Entertainment, including but not limited to D.J., Band, Dancing, or Competitions; occurring <br /> on Memorial Day Holiday, 4" of July Holiday, and Labor Day Holiday including the actual day of <br /> the holiday and weekend; will ensure a minimum of 6, uniformed security personnel who shall be <br /> hired for the sole purpose of providing security, two of which will be responsible at the location of <br /> the entrance to check identification. <br /> Conditions of Approval - 2 - PA-1100015 <br />
