Gau <br /> Sub : MS-93-105 (Bezley) <br /> Date: 1-6-94 <br /> Page: - 3 - <br /> PROJECT DESCRIPTION: <br /> This is a proposal to subdivide a 236-acre parcel to create four 5-acre lots and a remainder of 216 acres. <br /> The lots are located along the north side of an existing lake. The Southern Pacific Railroad tracks and <br /> Bear Creek are located south of the lake and traverse the remainder. Proposed access to the four parcels <br /> is by State Route 12 via a private road. <br /> ISSUES: <br /> General Plan Consistency: <br /> Agricultural Lands Objective 1 of the General Plan is: <br /> 'To protect agricultural lands needed for the continuation of commercial agricultural enterprises, <br /> small-scale farming operations, and the preservation of open space.' <br /> This application is inconsistent with this General Plan objective due to the creation of multiple homesites <br /> and the resulting fragmentation of agricultural lands. <br /> Agricultural Policy No. 7 states that there shall be no further fragmentation of land designated for <br /> agricultural use, with three exceptions. One exception that this and other homesite subdivisions have <br /> been filed under is: <br /> 'Parcels for homesites may be created, provided that the General Plan density is not exceeded.' <br /> The proposed subdivision, while consistent with Agricultural Policy No. 7, is not consistent with Objective <br /> No. 1. In order to be approved, the project must be consistent with all, not selected, pertinent General <br /> Plan Objectives and Policies. <br /> Environmental: <br /> An Initial Study prepared for this project determined that there is substantial evidence to indicate that <br /> development of this site may have a significant impact on the environment. The creek and the lake may <br /> contain rare plants, animals, and archeological artifacts. Without further studies to determine the extent <br /> of sensitive areas and appropriate mitigation measures, an EIR is required prior to approval. <br /> TG/CM/blm <br /> Attachments <br />
