Gau <br /> Sub : MS-93-105 (Bezley) <br /> Date: 1-6-94 <br /> Page: - 4 - <br /> ATTACHMENT A <br /> CONDITIONS, IF APPROVED <br /> Unless otherwise specified,all Conditions of Approval and ordinance requirements shall be complied <br /> with prior to recording the Parcel Map. <br /> This approval will expire three (3) years from the date of approval unless (1) all Conditions of <br /> Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the <br /> Surveyor's Division. <br /> Those conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Parcel 1 shall share a property line with the remainder. <br /> b. All numbered parcels shall have a minimum width of 150 feet. (Development Title Section <br /> 9-610.2) <br /> C. Parcels 1 through 4 shall be between 2 net acres and 5 gross acres in size. <br /> (Development Title Section 9-610.3[a]) <br /> d. The following note shall be placed on the Parcel Map and also recorded as a separate <br /> instrument: <br /> • In accordance with Section 9-610.3 of the San Joaquin County Development Title <br /> for the creation of homesite parcels, these parcels (including any remainder) <br /> cannot be further subdivided. <br /> e. Parallel to Bear Creek, a natural open space for riparian habitat and waterway protection <br /> shall be maintained to provide nesting and foraging habitat and the protection of <br /> waterway quality. The minimum width of said open space shall be 100 feet, measured <br /> from the mean high water level of the natural bank or 50 feet back from the existing <br /> riparian habitat, whichever is greater. Water-dependent uses may be permitted in this <br /> buffer. <br /> The mean high water level and the edge of the riparian habitat shall be shown on the <br /> Parcel Map. The open space buffer required above shall be shown on the Parcel Map <br /> with the following note: <br /> Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this <br /> area is designated as a natural open space for riparian habitat and waterway <br /> protection. No development other than water dependent uses shall be permitted <br /> in this space. <br />
