Recommendations
Action
It is recommended that the Planning Commission'
1. Approve the Negative Declaration; and
2. Approve Use Permit Application No. PA-0800350 with the Findings,Williamson Act Compatibility
Principles and Conditions of Approval contained in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any
applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
This finding can be made because the Use Type: Wineries and Wine Cellars, Winery- Large
may be conditionally permitted in the AG40 zone (General Agriculture, 40-acre minimum)
with an approved Use Permit application. The project site has a General Plan designation of
AIG (General Agriculture) and is within an agriculturally developed area. There are no
applicable Master Plans, Specific Plans, Special Purpose Plans, or any other applicable
plans which are within the vicinity of this project.
2 Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
This finding can be made because the applicant has sufficient access to water with an on-
site well. Sewer will be maintained with a septic system. Stormdrainage will remain on-site.
A wastewater connection to the City of Lodi receives wastes from the winemaking process.
Furthermore, adequate roadway access and parking have been provided.
3 The site is physically suitable for the type of development and for the intensity of development.
This finding can be made because the proposed project site of 4.5 acres, being a portion of
the 80-acre parcel, is of adequate size and shape to accommodate the proposed use and
all yards, building coverage, setbacks and other requirements of the Development Title.
The Site Plan demonstrates that there is sufficient area for parking and circulation and is
in compliance with the Development Title Section 9-1015. The modification of the parking
requirement can be accommodated on the project site due to the number of employees
and the marketing events and winery operations occurring at differing times.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding can be made because the Initial Study prepared for the project found no
potentially significant environmental impacts.
San Joaquin County PA-0800350Nan Ruiten
Community Development Page 5
