The Board is issuing waste discharge requirements, and <br /> b. The discharge complies with the Basin Plan, and <br /> C. The wastewater does not need to be managed according to 22 CCR, Division 4.5, <br /> Chapter 11, as a hazardous waste. <br /> 33. The Board has notified the Discharger and interested agencies and persons of its intent to prescribe <br /> waste discharge requirements for this discharge and has provided an opportunity for a public <br /> hearing and an opportunity to submit written comments. <br /> 34: The Board, in a public meeting, heard and considered all comments pertaining to the discharge. <br /> IT IS HEREBY ORDERED that R. Lawson Enterprises its agents, successors, and assigns, in order <br /> to meet the provisions contained in Division 7 of the California Water Code and regulations adopted <br /> thereunder, shall comply with the following: <br /> A. Discharge Prohibitions: <br /> 1. Discharge of wastes to surface waters or surface water drainage courses is prohibited. <br /> 2. Discharge of any winery wastewater, defrost water, stormwater, or other liquid wastewater to <br /> the existing wastewater pond is prohibited. <br /> 3. Addition of antiscale additives or other chemical compounds to defrost water is prohibited. <br /> 4. Neither the treatment nor the discharge shall cause a nuisance or condition of pollution as <br /> defined by the California Water Code, Section 13050. <br /> 5. The discharge shall not cause the degradation of any water supply. <br /> 6. Bypass or overflow of untreated or partially treated waste is prohibited. <br /> 7. Discharge of waste classified as `hazardous,' defined in Section 20164 of Title 27, CCR, or <br /> `designated,' as defined in Section 13173 of the California Water Code, is prohibited. <br /> B. Discharge Specifications: <br /> 1. Discharge of winery wastewater to the application area described in Finding No. 17 shall not <br /> exceed a flow rate of 5,000 gallons per day. For flow rate limit considerations,wastewater <br /> does not include stormwater or defrost water. <br /> 2. Application of winery wastewater to the land application areas during rain events or when the <br /> soil is saturated is prohibited. Stormwater and defrost water may be applied to the cropland <br /> during rain events but not in areas where the soil is saturated. <br /> 3. Application of winery wastewater to fallow land is prohibited. <br />
