The Division monitors farmland.
conversion on a statewide basis and administers the California Land Conservation (Williamson)Act and
other agricultural land conservation programs. We,offer the following comments and recommendations
with respect to the project's impacts on agricultural land and resources.
Project Description
The project is located on the northern side of State Highway Route 26 approximately 1,500 feet west
of Shelley Road near the community of Linden (APN 067-230-01 and 067-240-03).
The applicant is proposing a Minor Subdivision for 911:83 acres of land still enforceably restricted by
a Williamson Act contract, although the subject property is currently in non-renewal status and the
contract is scheduled to expire in 2015. The proposal includes the division of the land into eleven
parcels. Ten of the parcels are to contain 80 acres or more, while the remaining parcel will contain
106 acres.
Subdivision of Williamson Act Contracted Land
The overarching purpose of the Williamson Act is to curb "the rapid and virtually irreversible loss of
agricultural land to residential and other developed uses" (Sierra Club v. City of Hayward (1981) 28
Cal. 3d 840, 850) and.to protect farmland from conversion into "scattered, low density, single family
subdivisions." .(Honey Springs Homeowners Assn. v. Board of Supervisors (1984) 157 Cal. App. 3d
1122, at. 1139). .
The Department of Conservation's mission is to balance today's needs.with tomorrow's challenges and foster intelligent, sustainable,
and efficient use of California's energy, land, and mineral resources.
