L <br /> F, The Federal Comprehensive Environmental Response, Compensation and Liability Act <br /> (CERCLA) (42 USC §9601), which defines far-reaching joint, several and retrospective <br /> !� liability for environmental cleanup costs, also includes landowner liability protections for <br /> -� innocent landowners,bona fide prospective purchasers, and contiguous property owners, <br /> provided that certain conditions are met. One of these conditions is that"all appropriate <br /> 5 inquiries" (AAl) must be made into present and past environmental conditions at the site. <br /> Performance of a Phase I Environmental Site Assessment according to ASTM Standard <br /> f E1527 has been the industry standard method for such inquiries for over 10 years. In <br /> J November 2005, the US Environmental Protection Agency (USEPA) released the first <br /> official Federal Rule for conducting "all appropriate inquiries"(40 CFR Part 312). In <br /> accordance with§312.11 of the AAI rule, this assessment has been conducted in accordance <br /> with ASTM Standard, E1527-05, as a method of complinace with that rule. <br /> According to the AAI rule, "All Appropriate Inquiries are intended to result in the <br /> identification of conditions indicative of releases or threatened releases of hazardous <br /> substances on, at, in, or to the subject property."
