SAN JOAQUIN COUNTY The California Reg ioral 14a ter Quality Control Board, Central Valley Region, (hereafter Board) finis that: 1 , Trinkle and Boys Ag Flying Service, Inc. , (hereafter Discharger) operates a pesticide application business (facility) located at 31244 S. Highway. 33, lr•acy, in the southeast quarter of the southeast quarter of Section 17, ['_iS, R6E, MDB&M. (S(.:.,e map, Attachment 1. ) 2. The Discharger currently collects pesticide rinse water and stores it in an above-ground tank for reuse or off-site disposal . However, for approx- imately 40 year-, prior to 1956, the Discharger caused rinse water to be discharged to ground at this facility. This disposal history indicates that pesticide residues in site soil have been, or probably will be, discharged into waters of the state. 3. Area ground water- is less than 10 feet below the surface. The facility is within the New Jerusalem Drainage District, and tile drained areas exist less than one-quarter mile east and one-half mile west of the facility. The tile drainage is discharged to the San Joaquin River. Area surface drainage also flows towards the San Joaquin River. a.. Beneficial uses of the San Joaquin River are agricultural and industrial supply, recreation, and fish and wildlife habitat. 5. Beneficial uses of the area ground water are irrigation, stock watering, and industrial and domestic upply, Ground water serves the domestic needs of residences locat.�:�d itrenediately adjacent to this facility. 6. The Board ' s Water- Quality Control Plan was amended by Resolution 79-149, adopted 22 June 1.919, to read "Facilities developed for handling pesticide rinse waters shall riot allow percolation to underlying soils or ground waters, " 7, Sampling conducted by Board staff on 17 June 1986 revealed that 12 pesti- cides were present in the shallow ("perched") ground water encountered at 18 inches depth adjacent to the application equipment wash area at the site. Additional pesticides were present in soil samples from the facil- ity. Because pesticide residues have entered the perched water, and have entered or are likely to enter the lower ground water or surface water, the Discharger has created, or threatens to create, a condition of nuisance and pollution. 8. On 17 March 1987, the Discharger was requested, pursuant to Section 13267 of the California Water Code, to submit a work plan and time schedule for an investigation to determine the horizontal and vertical extent of soil contamination and ground water degradation caused by on-site waste dis- charge.
