San Joaquin St., Suite 627 <br /> Stockton, CA 95202 <br /> Dear Board Members: <br /> PUBLIC HEARING REGARDING THE APPEAL BY JUDY AND ROMANO ISOLA OF <br /> THE PLANNING COMMISSION'S APPROVAL OF SITE APPROVAL APPLICATION <br /> NO.PA-1200063 OF VERN AND JENISE VIERRA(C/O ST.JORGE WINERY) <br /> (FOURTH DISTRICT) <br /> RECOMMENDATION: <br /> It is recommended that the Board of Supervisors deny the appeal and uphold the Planning <br /> Commission's approval of Site Approval No. PA-1200063. <br /> BACKGROUND: <br /> This is an appeal of the Planning Commission's approval of a Site Approval application for the <br /> expansion of an existing small winery and to increase the number of marketing events and <br /> attendees per marketing event. (Use Type: Wineries and Wine Cellars—Winery, Small) The <br /> applicant is seeking to legalize a wine garden structure and commercial kitchen that were built <br /> without benefit of the required permits. The expansion includes the construction of a 5,652 square <br /> foot wine garden comprised of a stage, dining, and seating area, a 300 square foot commercial <br /> kitchen, a 1,600 square foot storage building, a 336 square foot wine storage building, a 288 <br /> square foot covered patio, a 420 square foot restroom facility, and increase the number of <br /> marketing events from the previously approved four marketing events to twenty-four marketing <br /> events per year and increase the number of attendees from the previously approved 25 people to <br /> 150 people per marketing event. <br /> The Community Development Department opened an enforcement case (EN-1200170) for this <br /> property on April 12, 2012. Enforcement action was taken due to the construction of the wine <br /> garden without the benefit of required permits and expansion of the land use without benefit of <br /> required permits.Upon further review of the property, a commercial kitchen was also <br />
