Item No. 5
PC: 1-2-92
MS-92-48
Page 4
subdivision. This finding can be made because reasonable public access to the Mokelumne River
is available at the Peltier Road crossing located approximately 200 feet southeast of the property.
ENVIRONMENTAL CONSIDERATIONS:
In a letter dated November 11, 1991, the California State Department of Fish and Game stated: 'The
Mokelumne River provides significant fish and wildlife habitat. In orderto protect water quality and riparian
habitat, we recommend that the subject Minor Subdivision application be conditioned so that a 100-foot
nonstructural buffer is established along the Mokelumne River.' Such a condition is included in the
recommended conditions of approval. The letter also stated: 'This project will have an impact on fish
and/or wildlife habitat. Assessment of fees under Public Resources Code Section 21089 and as defined
by Fish and Game Code Section 711.4 is necessary. Fees are payable by the project applicant upon
filing of the Notice of Determination...'
An Initial Study was prepared for this project on November 11, 1991, and no significant environmental
impacts were identified. The Initial Study was later amended to include the comments from Fish and
Game. On the basis of that review, a Negative Declaration was prepared.
