Analysis <br /> Background <br /> This project is currently under enforcement(EN-02-0806). The applicant has continued to use the site <br /> without the proper permits. The current use includes three or more trucks and up to 18 trailers. This <br /> exceeds the use approved under this Site Approval. <br /> Appeal Statements <br /> Appeal Statement No. 1: <br /> "We would be unable to complete all conditions within this construction season." <br /> Response to Appeal Statement No. 1: <br /> The Enforcement Division has reviewed this application and has determined that the time frame for meeting <br /> Condition 1.c.(3) is appropriate for this project. <br /> Appeal Statement No. 2: <br /> "We would like to appeal the widening of Temple Creek Road to 20 feet. The widening is not feasible <br /> because the cost would be equal to about one year's gross salary. Also, this road is used by the dairy daily." <br /> (Condition 1.i.[2]) <br /> Response to Appeal Statement No. 2: <br /> Condition 1.i.(2) is an ordinance requirement. Development Title Section 9-605.6(f)(2) states that a permit <br /> approval for truck parking as an accessory use in an agricultural zone shall require that the property fronts <br /> on a County-maintained road with a minimum twenty (20) foot width of pavement. The Public Works <br /> Department lists the pavement width of Temple Creek Road as 18 feet. The measured width varies from <br /> less than 16 feet to 19 feet along most of its length. There is a portion near Skiff Road that meets the 20- <br /> foot ordinance requirement.
