Analysis—Use Permit <br /> Agricultural Mitigation <br /> Although the issue of impacts to agriculture was not addressed as part of the EIR, the County nevertheless requires <br /> mitigation for the loss of agricultural resources based on the prior General Plan amendment for the project site, as <br /> described earlier.A portion of this project area(5.06 acres)was changed from an agricultural designation to a non- <br /> agricultural designation (A/G to C/FS)and an agricultural zone to a non-agricultural zone(AG-40 to C-FS)on March <br /> 1, 2011.All General Plan Amendments that change the designation of any land from an agricultural to a non- <br /> agricultural use or Zone Reclassifications that change the permitted uses from agriculture to a non-agricultural use <br /> approved after January 9, 2007 are subject to agricultural mitigation (Development Title Section 9-1080.3[a]). 5.1 <br /> acres of the project site are subject to this mitigation.Agricultural mitigation shall be satisfied by granting a farmland <br /> conservation easement or other farmland conservation mechanism to or for the benefit of a qualifying entity. The <br /> number of acres of agricultural mitigation land must be at least equal to the number of acres that are changed to a <br /> non-agricultural use. Submission of the required legal instrument or payment of the in-lieu fee must occur at the time <br /> of Grading Permit or Building Permit issuance(Development Title Section 9-1080.3[f]). <br /> Council of Governments <br /> San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP). Participation in the plan satisfies requirements of both the state and federal endangered <br /> species acts, and ensures that the impacts are mitigated below a level of significance in compliance with the <br /> California Environmental Quality Act. Although participation in the SJMSCP is voluntary, if the applicant chooses <br /> not to participate, the applicant will be required to provide alternative mitigation in an amount and kind equal to that <br /> provided in the SJMSCP.
