Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Certify Final Environmental Impact Report No. PA-1200065 under the provisions of Section 15090 of the <br /> California Environmental Quality Act (CEQA) (Attachment A). <br /> 2. Adopt"Findings of Significant Environmental Impacts" (Attachment B). <br /> 3. Adopt"Statement of Overriding Considerations" (Attachment C). <br /> 4. Adopt the "Mitigation Monitoring Program" (Attachment D). <br /> 5. Approve Use Permit Application No. PA-1000131 with the Findings and Conditions of Approval contained <br /> in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan adopted by the <br /> County. <br /> • This Finding can be made because the establishment, maintenance and operation of a truck stop <br /> do not conflict with the General Plan. The use proposed in application PA-1000131 is consistent <br /> with the Freeway Service General Plan designation, which in turn may be conditionally permitted in <br /> the Freeway Service Commercial zone with an approved Use Permit application. The project will <br /> also be consistent with PA-0700226, the Flag City Special Purpose Plan. Projects that use the <br /> services of CSA 31 are subject to the Flag City Special Purpose Plan. The Flag City Special <br /> Purpose Plan includes design review regarding landscaping and parking. The Special Purpose <br /> Plan is implemented with the building permit. There are two other Special Purpose Plans in the <br /> vicinity. The project meets the requirements of Special Purpose Plan PP-98-0003,Thornton <br /> Road/Star Road, regarding realignment and circulation and PP-94-0002 regarding a comprehensive <br /> sign plan. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary facilities <br /> have been provided, and the proposed improvements are properly related to existing and proposed roadways. <br /> • This Finding can be made because adequate utilities, access roads, sanitation, drainage and other <br /> necessary facilities will be provided and the proposed improvements are properly related to <br /> existing and proposed streets and highways. Public sewer, public water, and terminal storm <br /> drainage will be provided by CSA 31. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This Finding can be made because the property involved is of adequate size and shape to <br /> accommodate the proposed truck stop and restaurants and all yards, building coverage, setbacks, <br /> parking areas and other requirements of this Title.This project will also meet the requirements of <br /> the Flag City Special Purpose Plan. <br /> San Joaquin County PA-1000131\Highway 12 Investors <br /> Community Development Page 8 <br />
