OPPONENTS: Tam Terpstra said that Flying J is concerned about the traffic issues that will occur with this project. He believes that the traffic impacts are understated and that this might cause an increase in the LOS. He said that Finding 2 cannot be made because of their concerns about traffic impacts. Finding 4 cannot be made because of concerns about land use compatibility: Commissioner Mom said that Caltrans has approved the traffic study., Tom Terpstra said they did not agree entirely with the study. The trip generation rate is a concern. REBUTTAL: Mike Hakeem said the traffic study took several months to prepare. The General Plan and Zone Reclassification proceeded with the traffic study. The Use Permit had to wait until that process was completed. PUBLIC HEARING CLOSED: Commissioner Villapudua said he is in favor of competition and thinks this project would be good for the County. Commissioners Morri and Johnson said they can make all the findings. MOTION: It was moved,seconded (Moni/Villapudua), and passed by a unanimous roll call vote(40)to: 1. Approve the Negative Declaration; and 2. Approve Use Permit No. PA-1000131 with the Findings and Conditions of Approval contained in the staff report,with the addition of Condition 1.(I) and a revision of Condition 2.(f),as follows: 1.(I) A IGATION EASEMENT: An avigation easement shall be recorded in favor of the Kingdon Airport and ensures compliance with the 2009 Airport Land Use_Compatibility Plan. 2.(f) Thornton Road shall be improved along the p1plect frontage , wid 0 in conformance with the standards for one half of an 84-foot-wide right-of-way Minor Arterial urban street with full curb,gutter, and sidewalk improvements. The structural section shall be based on a traffic index determined for existing plus future traffic and shall meet a minimum 20-year roadway design life.
