UP-00-11 OF JOHN AND CAROL BENDER. -------------------------------------------------------------------------------------------------------------------- The applicants, John and Carol Bender, have submitted the above referenced Use Permit Application to permit a horse boarding and training facility (30 Horses maximum) with a picnic area for patrons. The project site is located on a private driveway located on the east side of Thornton Road at the intersection of Barber and Thornton Roads, north of Thornton. A portion of the project site is located within Sacramento County. This item will be scheduled to be considered by the San Joaquin County Planning Commission after the issues discussed below are resolved. GENERAL INFORMATION After reviewing the application and material from other agencies, the Community Development Department offers the following comments: Enforcement The site is under enforcement proceeding by the Community Development Department (CDD) for junk and trash on the property, boarding horses without permits, and containers and buildings on site without permits. The Environmental Health Division (EHD) has requested a minimum thirty-(30) days continuance because of several alleged health violations on the site. PROJECTISSUES • A draft Initial study has identified a potential significant adverse impact on the site. The Natural Diversity Data Base shows that the project site may provide habitat for the Swainsons Hawk. The Community Development Department is awaiting a reply from the State Fish and Game Department concerning this issue. This issue must be resolved before the Planning Commission public hearing will be scheduled.
