UP-00-11 OF <br /> JOHN AND CAROL BENDER. <br /> -------------------------------------------------------------------------------------------------------------------- <br /> The applicants, John and Carol Bender, have submitted the above referenced Use <br /> Permit Application to permit a horse boarding and training facility (30 Horses maximum) <br /> with a picnic area for patrons. The project site is located on a private driveway located <br /> on the east side of Thornton Road at the intersection of Barber and Thornton Roads, <br /> north of Thornton. A portion of the project site is located within Sacramento County. <br /> This item will be scheduled to be considered by the San Joaquin County Planning <br /> Commission after the issues discussed below are resolved. <br /> GENERAL INFORMATION <br /> After reviewing the application and material from other agencies, the Community <br /> Development Department offers the following comments: <br /> Enforcement <br /> The site is under enforcement proceeding by the Community Development Department <br /> (CDD) for junk and trash on the property, boarding horses without permits, and <br /> containers and buildings on site without permits. <br /> The Environmental Health Division (EHD) has requested a minimum thirty-(30) days <br /> continuance because of several alleged health violations on the site. <br /> PROJECTISSUES <br /> • A draft Initial study has identified a potential significant adverse impact on the site. <br /> The Natural Diversity Data Base shows that the project site may provide habitat for <br /> the Swainsons Hawk. The Community Development Department is awaiting a <br /> reply from the State Fish and Game Department concerning this issue. This issue <br /> must be resolved before the Planning Commission public hearing will be <br /> scheduled. <br />
