She said that there should be an adherence <br /> to the 40 ' setback requirement. <br /> Vicki Nannizzi, 12953 Tokay Colony Road, said she felt that there <br /> should be fewer than 15 dogs on the property. She also said that the <br /> Barry dogs cause the other dogs in the neighborhood get noisy. <br /> Floyd Wood, 12847 Tokay Colony Road, said the Irish Wolfhounds look <br /> ferocious and are noisy. <br /> REBUTTAL: Mr. Barry said they have never had more than 11 adult dogs. <br /> During a 11 year period of time, they have had 3 litters. They <br /> average less than one litter a year. The Irish Wolfhound is not a <br /> very popular dog and he could not find a place to take care of large <br /> numbers of puppies. At one time they had 2 litters simultaneously and <br /> most of those were gone within 10 weeks. <br /> Mr. Barry said he plans to modify the barn for kennels. Irish <br /> Wolfhounds are not vicious but they are territorial and will go up to <br /> the fence and bark at a horse. He said he intend's to fix that problem <br /> by fencing the property. He said that 9 people signed a statement <br /> saying they were not in opposition. The rental property referred to <br /> by Mrs. Harris was remodeled and it is now a residence. He had not <br /> counted on that rental unit being occupied. <br /> Mr. Barry said that paddocks will be constructed and this will keep <br /> some of the barking down. He said he and his wife are concerned that <br /> the neighbors find them acceptable. At times, the dogs do bark and <br /> this is for a short period of time. He said he felt that much of the <br /> concern of the neighbors is regarding property values. He and his <br /> wife are also concerned about this . <br /> Maria Barry also spoke in rebuttal. <br /> Mrs. Satterness noted that the Commission received one letter in <br /> favor , one letter in opposition and one letter of concern. Staff <br /> received a phone call from a neighbor stating they had no opposition. <br /> She pointed out that the Barrys submitted a petition. <br /> PUBLIC HEARING CLOSED <br /> Comm. Morri said that the Barry property is well maintained. <br /> Comm. Bozzano said his concern was as to the noise problem. However, <br /> in the past, the Commission has given applicants the chance to prove <br /> that they can be a benefit to their areas and to the neighbors. He <br /> asked if the applicant needed 15 dogs. <br /> Comm. Morri said that the applicant explained that he will select two <br /> out of a litter and sell the other dogs off .
