(b) Exceptional Circumstances. There are exceptional or extraordinary circumstances <br /> or conditions applicable to the property or to the intended uses that do not apply to <br /> other properties in the same zoning district in the vicinity; <br /> (c) Denial of Privileges. The strict application of the regulation deprives the property of <br /> the privileges enjoyed by other properties in the vicinity; and <br /> (d) Consistency. The proposed use is consistent with the goals, policies, standards, <br /> and maps of the General Plan; any applicable Master Plan, Specific Plan, and <br /> Special Purpose Plan; and any other applicable plan adopted by the County. <br /> If the applicant chooses to file a full application for the Deviation, the applicant will need <br /> to state how the project is able to meet these findings. All four findings must be made in <br /> the affirmative to be able to approve the Deviation application. The explanation citied by <br /> the applicant regarding the ability to alter the size of a lot by ten percent (10%) stated in <br /> Development Title 9-8224(b)(2) does not by itself address findings b & c. In regards to <br /> finding "b", the applicant needs to explain what exceptional circumstances exist in <br /> regards to his property. Examples of exceptional circumstances include size, shape, <br /> topography, location or surroundings that prevent the property owner from enjoying <br /> privileges enjoyed by other property owners in the same zone or vicinity. Concerning <br /> finding "c", the applicant needs to explain how the strict application of the 5-acre <br /> minimum standard in the AL-5 zone, results in the applicant being deprived of privileges <br /> enjoyed by others in the vicinity. <br /> Next Step <br /> When the applicant is ready to submit a full application for a Deviation, it will be <br /> necessary to do the following: <br /> • Submit seven (7) copies of the completed Deviation application form. <br /> • Submit seven (7) copies (18" x 26") of the site plan and two reduced copies (8 '/2" <br /> x 11°) of the site plan. <br /> • Submit a copy of the recorded deed(s) of the property. <br /> NOTE: The pre-application conference is designed to inform prospective applicants of <br /> General Plan consistency, zoning consistency, public improvement requirements, <br /> preliminary design constraints and opportunities, and major environmental and safety <br /> issues. This information is provided in the hope of assisting the applicant in submitting a <br /> better and more complete application, as well as minimizing processing time. It is not <br /> intended to be an in-depth analysis, and an environmental assessment is not completed. <br /> The applicant should be aware that a detailed review will not be done until the full <br /> application is submitted.
