A video tape of the planned haul route showing conditions of all County roads. The condition of <br /> San Joaquin County maintained roads along the haul route shall be reviewed with the department <br /> of Public Works prior to the start of excavation. <br /> (Development Title 9-1415.2) <br /> 5. Loads on all public roads shall be required to legal loads only. <br /> (Street and Highway Title Section 10-2350) <br /> 6. An encroachment permit shall be required for work within road right-of-way. <br /> (Development Title Sections 9-1145.4 and 9-1145.5) <br /> 7. A cash deposit or security in the amount and form acceptable to the Department of Public Works <br /> shall be filed with the Department with a guarantee that if the permittee fails, refuses or neglects <br /> to repair, under permit, any damages to any County roads along the haul route which may result <br /> from permittee's operation,the Department of Public Works may do the work necessary to <br /> restore County roads along the haul route to equal or better than, original condition, using the <br /> funds from said cash deposit or security. <br /> (Development Title 9-854.3) <br /> 8. A Maintenance Agreement to ensure that Tracy Boulevard, Linne Road, Banta Road, and <br /> Eleventh Street are maintained to a condition acceptable to San Joaquin County shall be executed <br /> by the applicant. In leu of the maintenance agreement, a one time road maintenance fee may be <br /> acceptable to the County. Application for the in leu fee may be made to the Department of <br /> Public Works. <br /> 9. The Traffic Impact Mitigation Fee shall be required for this development. The fee is due and <br /> payable at the time of building permit application. The fee currently is $190.77 per trip-ends in <br /> the Tracy area. The fee shall be automatically adjusted July 1 of each year by the Engineering <br /> Construction Cost Index as published by the Engineering News Record. The number of trip-ends <br /> may be determined by a proportion to the length in time of the excavation operation. <br /> (Resolutions R-00-339) <br /> 10. Caltrans determined that this project will contribute to cumulative impacts at the overcrossing of <br /> Tracy Boulevard at I-580. The applicant shall pay Caltrans impact fees on a"Fair Share"basis <br /> towards future improvements at this intersection. <br /> 11.
