t <br /> TO: San,Joaquin County Planning Commission <br /> RE:Action approval No. PA-0800180; Dino Mencarini(Abundance Vineyards) <br /> Date: 12/16/10 <br /> Unfortunately,we live in an age of"it's all about me"mentality:The concerns you hear tonight are about US,the residents <br /> of Turner Road who are affected by the activities of Abundance Winery and by your decision tonight. <br /> US,the neighbors who live in homes on properties that afford us a sense of calm and quiet:the type of living conditions <br /> not usually found in traditional city neighborhoods. That is why we live where we live. <br /> I will admit that 1,for one, looked forward to the addition of the winery and was pleased with the resulting aesthetically <br /> pleasing property. I had even suggested to other neighbors that we send a welcome floral bouquet to the tasting room <br /> when they opened for business. There was never resentment nor malice towards the original intent of this business. <br /> Unfortunately,we are now at a crossroads with Abundance;what could have been a source of pride and excitement has <br /> turned into a battlefield. <br /> While it is true that the Mencarini's have been long time residence and owners of many grape-growing acres within the <br /> Lodi community, Dino Mencarini's°squatters rights"attitude has become tiresome.Claims of"I was here first and can do <br /> what I want'seem to be his theme. One evening of particularly laud music, I called Abundance to request the speakers be <br /> turned down a bit. I was told by the female who answered that"we have a permit and can do what we want."Other <br /> attempts to make phone contact were thwarted by their answering machine.Accommodating and responsive?NO. <br /> Arrogant?YES! <br /> Although we were not able to obtain, prior to this meeting, public records of calls received by the Sheriff Department <br /> during these events, I can say with certainty that the number is significant. On more than one occasion, I was told by <br /> responding officers that the permits were in order and the only thing the officers could do was to ask that the volume be <br /> tumed down(which never was). While it is true that there is a permit, it states that up to SEVEN events PER YEAR are <br /> allowed. It was also recommended that I get in touch with the Code Enforcement Division,which I did.Although written <br /> that`enforcement action was taken"(pg.3 of report)the office acknowledged the inability to monitor and enforce the <br /> provisions of the permit due to the fact personnel is not available to do an on-site even visit after normal business hours <br /> and the timing of the events. It is also noteworthy to remind you of comments made in the analysis document under the <br /> Williamson Act section.This has turned into a cycle of frustration and dread. <br /> I don't know that the concerns of one person will affect your decision on tonight's vote. But as one person, I am begging <br /> you to reject the revision of Condition of Approval for Abundance Winery.Without exaggeration, I have become physically <br /> ill and mentally distressed each time I have been subject to the noise permeating during these events. n might also note <br /> that on three separate occasions, and by three separate friends living in Woodbridge AND in the Parkwest neighborhood <br /> called to say THEY could hear the music.These are people who We literally miles from the source.)Along with others <br /> here tonight, I am not against the occasional concert or event. But to endure this nuisance weekend after weekend for <br /> months at a time is more than ANYONE should have to tolerate. Contrary to the recommendations documented in the <br /> Community Development Staff Report under Revised Findings,94"Issuance of the permit will not be significantly <br /> detrimental to the public health, safety, or welfare, or be injurious to the property or improvements of adjacent properties, <br />' approval of this proposed use permit WILL have significant negative affect on the surrounding residence. <br /> Respectfully, <br /> Nancy Henne er <br /> f <br /> 850 W.Tumer Rd.
