The Division monitors farmland conversion on a statewide basis and administers <br /> the California Land Conservation (Williamson) Act and other agricultural land conservation <br /> programs. We offer the following comments and recommendations with respect to the <br /> proposed project's potential impacts on agricultural land and resources. <br /> Project Description: <br /> The project is a minor subdivision of a 40-acre parcel to create one parcel of 10 acres <br /> and a designated remainder of 30 acres. The project site is west of Lodi, on the south <br /> side of Turner Road in San Joaquin County. The project notes that the site is under a <br /> Williamson Act contract. <br /> Division Comments: <br /> The Division notes that this project does not meet the requirements of Government Code <br /> § 66474.4 or §51222. This is because the GIS data sent to the Division from the County <br /> as part of the annual Open Space Subvention Application, indicates the parcel has been <br /> designated as Williamson Act non-prime. Even if the County had made the designated <br /> findings for this project required under Government Code § 66474.4(c)(1 ), the project <br /> would still not meet the County's own regulations, which state: "The minimum size parcel <br /> of other than prime agricultural land which will qualify for a [Williamson Act] contract shall <br /> be forty (40) acres."' <br /> ' Chapter 9-1810.2(b) Requirements for Application, Division 18 Williamson Act Regulations.
