They may submit an application to the County for a Williamson Act contract cancellation, or submit a lot-line adjustment that will enable the parcel(s) under contract to maintain the minimum lot size requirements under statute and ordinance. While the applicant can also file a notice of non-renewal with the County, they would be unable to apply for a 10-acre parcel with 30- acre designated remainder until the contract term had expired. Cancellation notification must be submitted to the Division when the County accepts a Williamson Act cancellation application as complete (Government Code § 51284.1), and the Board must consider the Department's comments prior to approving a tentative cancellation. Required findings must be made by the Board in order to approve a tentative cancellation (Government Code § 51282(c)), and a cancellation fee would need to be paid prior to construction of the project (Government Code § 51283). Notification of the application for cancellation must be submitted to the Department of Conservation separately from the California Environmental Quality Act (CEQA) notification process.
