They may submit an application <br /> to the County for a Williamson Act contract cancellation, or submit a lot-line adjustment <br /> that will enable the parcel(s) under contract to maintain the minimum lot size <br /> requirements under statute and ordinance. While the applicant can also file a notice of <br /> non-renewal with the County, they would be unable to apply for a 10-acre parcel with 30- <br /> acre designated remainder until the contract term had expired. <br /> Cancellation notification must be submitted to the Division when the County accepts a <br /> Williamson Act cancellation application as complete (Government Code § 51284.1), and <br /> the Board must consider the Department's comments prior to approving a tentative <br /> cancellation. Required findings must be made by the Board in order to approve a <br /> tentative cancellation (Government Code § 51282(c)), and a cancellation fee would <br /> need to be paid prior to construction of the project (Government Code § 51283). <br /> Notification of the application for cancellation must be submitted to the Department of <br /> Conservation separately from the California Environmental Quality Act (CEQA) <br /> notification process.
