Analysis <br /> Background <br /> The Two Rivers RV Park historically has been recognized as a Recreational Vehicle Park and <br /> Campground. On Jdne 22, 1972 the Board of Supervisors approved Use Permit application U-72-357 for <br /> an 11 unit Recreational Vehicle Park. On November 25, 1980 the Board of Supervisors approved Use <br /> Permit application U-80-55 to expand the-existing Recreational Vehicle Park to permit 95 campsites, <br /> campground, and a boat ramp launch. On August 28, 1980 the Board of Zoning Adjustment approved <br /> Use Permit application U-80-55 to expand an existing 95-space Recreational Vehicle Park by adding 33 <br /> Recreational Vehicle_spaces, a manager's residence, a pool/spa, restroom facilities, and a Recreational <br /> Vehicle sanitation station. <br /> Flood Variance Findings <br /> For a Flood Variance-=application to be approved, five findings must be made in the affirmative. The <br /> applicant is requesting that the Flood Variance be granted based upon the ability to make all five findings. <br /> The applicant submitted findings for the application, below is a discussion and analysis of the findings: <br /> Finding One: There is good and sufficient cause for the flood variance. <br /> Applicant's Statement: "The use-at this site currently has a well on site, which has been in existence for <br /> over thirty years. This well will be destroyed to local and state standards once the new well has been <br /> roved for use a�a drinking water supply b Environmental Health Dept If the variance is not <br /> app g pp Y Y p <br /> granted, then the existing tenants and market would have to relocate, as the existing well is vulnerable to <br /> bacteria, life threatening pathogens and other surface water contaminants." <br /> This finding can be made because there is no other location, outside of the floodway,where the <br /> well can be placed;;. The existing well has been appraised and found to be beyond repair by two <br /> local pump companies so a new well must be installed. Additionally, the Environmental Health <br /> Department(EHD)..inspected the condition of the Two Rivers RV Park Water System drinking- <br /> water well on Octoer 6, 2009. The casing of the well was found to be severely deteriorated. The <br /> EMD immediately issued an Unsafe Water Alert Order,to prevent a water borne microbial disease <br /> out break. The Order requires the owner to notify all users of the water system to boil the well <br /> water for one mince before drinking or preparing food. The owner provided the notification to <br /> the users while EHD was at the site. The EHD also issued an Inspection Report to the owner <br /> requiring him to repair or replace the well to State and County standards immediately. <br /> Finding Two Failure<to grant the variance would result in exceptional hardship to the applicant_. <br /> Applicant's Statement:. "Yes, this site is a source of retirement income for the property owner and is the <br /> home site for the owner and several tenants without a replacement well there would not be any source for <br /> potable water on this parcel." <br /> This finding can be;made because by failing to grant the variance, the Recreational Vehicle Park <br /> and Campground would not have a water source that meets Public Health standards, and the <br /> owner who lives on the site would not have a potable drinking water supply. <br /> Finding Three: The flood variance will not result in increased flood heights, additional threats to public <br /> safety, extraordinary public expense create nuisances, cause fraud or victimization of the public,or <br /> conflict with existing local laws or ordinances. <br /> San Joaquin County PA-0900266/Turkmany <br /> Community Development i Page 3 <br />
