Applicant's Statement: "The relocation of the well will have an insignificant affect on the homes in the <br /> area, as the existing well will be destroyed and well components removed once the new well is approved <br /> for use as a drinking water supply by the Environmental Health Department." <br /> This finding can be made because the new well is an in-kind replacement of an existing well that <br /> will be demolished.'The destruction of the existing well will be completed by cutting the well <br /> casing to surface grade. The owner will not be allowed to use the existing pressure tank, as it <br /> does not meet current standards. To mitigate any increase in flood heights caused by the new <br /> well components, the current well equipment and housing could be removed from the site. The <br /> variance will allow the construction of a replacement well that meets current well construction <br /> standards which will increase the public's safety because microbes and other surface <br /> contaminants will not be able to enter the well water and impair the ground water drinking supply. <br /> This project will not create public expense or nuisances, and victimization of the public will not <br /> occur by replacing the well because the owner will pay for the cost of replacing the well. <br /> Additionally, the proposed well will not conflict with existing local laws or ordinances as an <br /> encroachment permit from the Central Valley Flood Protection Board will be required. <br /> Finding Four: The flood variance is the minimum necessary, considering the flood hazard, to afford re3ief. <br /> Applicant's Statement: "if a replacement well can not be drilled, then the current residents, owner and <br /> market would have to relocate, as the site would no longer have an approved source of water to supply <br /> the permitted Two Rivers RV Park water system. The RV Park operating within the floodway is consistent <br /> with other mobile home parks operating in the flood way within San Joaquin County& State of California." <br /> This finding can be made because the application seeks to deviate only from the prohibition of <br /> wells within floodways. The applicant shall meet all other floodplain development standards to <br /> protect the well and associated equipment from flood damage. Additionally, the installation of a <br /> new well is the minimum necessary relief to provide the users a reliable and adequate supply of <br /> healthful, potable water. <br /> Finding Five: Granting of the flood variance will not constitute agrant of special privileges inconsistent <br /> with the limitations on similarly situated properties subject to the County's flood regulations. <br /> Applicant's Statement: "As noted in #4, operation of a RV park in the floodway is consistent with other <br /> mobile home parks operating in the floodway in this county and in the State of California. This Flood <br /> Variance will not can a grant of special privileges and is consistent with other similar use within San <br /> Joaquin County." <br /> This finding can be made because the Flood Variance does not change any use that is not <br /> otherwise expressly authorized by the General Plan or Development Title. The Recreation- <br /> Campground use type (Recreation Vehicle Parks) is a conditionally permitted use in the AG-40 <br /> (General Agriculture, 40-acre minimum)zone, and the construction of a replacement well would <br /> not constitute a grant of special privileges inconsistent with the limitations on similarly situated <br /> properties subject to the County's flood regulations, <br /> San Joaquin County PA-0900266ITurkmany <br /> Community Development Page 4 <br />
