z <br /> { <br /> Neighborhood Opposition <br /> Staff has received one letter in opposition of the Flood Variance application. The letter raises issues <br /> regarding the potential for flooding hazards, fire access road, proper sewage, inadequate runoff drains water <br /> supply, access easement and road encroachments, substandard housing to include non-compliance with <br /> state law, length of stay, density, buffering of adjacent land uses and harassment. The concerns are r <br /> discussed below: f <br /> Flooding Hazards-As required by the Public Works Department the top of the well casing and the top of <br /> the concrete pad on Which the tank will be mounted shall be elevated a minimum of 2-feet above the base <br /> flood elevation of 39-feet referenced to the North American Vertical Datum of 1988. The.tank may be <br /> installed below the base flood elevation if certification is provided by a registered civil engineer that the <br /> all hydrostatic and hydrodynamic forces including tank is designed to resist a y9 the effects of buoyancy. <br /> r <br /> Certification of the tank pad, and well head elevations will be provided upon the finish of construction. <br /> Additionally, as a Condition of Approval, an encroachment permit will be required from the Central Valley <br /> Flood Protection Board. <br /> Fire Safety: The proposed project is for a Variance application only to replace an existing well: All fire <br /> district requirements for fire access roads regulations were reviewed during the permitting of the <br /> Recreational Vehicle Park. Additionally a referral was sent to the State Housing and Community <br /> Development Department. <br /> Proper sewage, inadequate.runoff drains and water supply: The San Joaquin County Department of <br /> Environmental Health.(EHD) has reviewed their records and found the EHD issued two septic system <br /> installation permits to contractors doing work at this facility. In 1972 a permit was issued for <br /> the installation of a septic system to served 11 spaces. In 1999 a permit was issued for the installation of <br /> an addition to the exiting septic system to serve 15 additional 'spaces. The septic system now has the <br /> capacity to serve 26,paces.- Additionally as required by EHD a Well Construction Permit will be issued <br /> with conditions to enure that the replacement well will be constructed in compliance with current <br /> California Well standbrds, San Joaquin County Well Construction standards, and Flood with. <br /> Board <br /> requirements. r - <br /> Easement and roar#.'encroachment: The proposed project is for a Variance application only to replace <br /> an existing well in the floodway. Any existing easement and road encroachment issues between property <br /> owners for access to`the Recreational Vehicle Park are not issues related to the required findings for a <br /> Flood Variance. <br /> Non-compliance with state law, length of stay, density and buffering of adjacent:land uses: The <br /> proposed project is for a Variance application only to replace an existing weir in the floodway. Residency, <br /> site area, and open space are not issues related to the required findings for a Flood Variance. <br /> Harassment: The proposed project is for a Variance application only to replace an existing well in the <br /> floodway. Any existing issues between property owners are not issues related to the required findings for <br /> a Flood Variance. <br /> i Referral Responses%- <br /> `f. <br /> The San Joaquin County Department of Public Works Flood Management Division and Environmental <br /> Health Department responded to the application referral with a recommendation that the Flood Variance be <br /> approved with the attached conditions contained in the Staff Report.
