Conditional Use Permit <br /> Pursuant to Section 9-821, a Conditional User Permit can be issued upon making the <br /> following four(4)findings: <br /> a. Consistency with the General Plan; <br /> b. Adequate improvements are provided for utilities, roadway, sanitation, water <br /> supply and drainage; <br /> and C. Site suitability for the type of development and for the intensity of development; <br /> d. Issuance not detrimental to the general public health, safety or welfare. <br /> Open Space/Resource Conservation <br /> The objective of the Open Space/Resource Conservation General Plan Classification <br /> (OS/RC) is intended to protect extractive resources from urban development or encroachment <br /> and to provide for the production of extractive resources while protecting people, property, and <br /> the environment from the hazards caused by resource extraction. However, the policy of the <br /> General Plan is that the OS/RC property is to remain in open space uses until extraction of <br /> resources, "unless the immediate area has been committed to other uses" (emphasis added). This <br /> particular 20 acre property at the corner of Valpico and Corral Hollow is in the urban community <br /> of Tracy. It is also adjacent to existing urban areas to the north and east. These adjacent areas <br /> are residential in both the General Plan and Zone classification. Moreover, there is another <br /> church in the area and, in any event, it is extremely difficult to excavate this small area adjacent <br /> to existing residential activity. In addition, there is no quarry activity in this area at this time. <br /> Therefore, the immediate area has been committed to other uses and should be excluded from the <br /> protective provisions of Volume 1 of the General Plan regarding policies at VI - 16, Objectives 1 <br /> and 2. <br /> Street Trees <br /> Along Corral Hollow <br /> Fraxinus oxycarpa'Raywood; Liriodendron tulipifera; or Platanus acerifolia'Yarwood' <br /> Along Valpico <br /> Celtis Sinensis; Liquidambar syraciflua'Palo Alto'; or Zelkova serrata <br />
