BERNARD'S PARISH <br /> Dear Ms. Allen: <br /> Thank you for the opportunity to comment on the above application. The City has been <br /> discussing the project with the applicant since 2003 and is supportive of the project. In <br /> 2003 the Tracy City Council authorized the negotiation of an Agreement for Service <br /> Connections and Annexation with the applicant. Some work was done on the <br /> agreement, but the agreement was never finalized. My understanding at the present <br /> time is that the applicant has scaled back the first phase of the development and will <br /> only need a connection to a City water line for fire flow to meet Buildingand Fire Code <br /> requirements. <br /> The City recommends that the following Conditions of Approval be placed on the <br /> Conditional Use Permit: <br /> • The applicant and the City shall execute an Agreement for Service Connections <br /> and Annexation with the City prior to the County's issuance of a Building Permit. <br /> (Note: It is probable that annexation to the City will be required at such time as <br /> the property becomes eligible to annex.) <br /> • The applicant shall connect, in accordance with said agreement, to the City water <br /> line for fire flow prior to the County's issuance of a Building Permit. The applicant <br /> shall pay the standard charge for connection and meter to the City and shall build <br /> said line in accordance with City standards <br /> • The applicant shall pay the cost necessary for the City to analyze the existing <br /> water line in Valpico, which contains stagnant water, to ensure that there is <br /> adequate fire flow for the project. <br /> •' Storm water runoff shall be retained on site until connection to a storm drainage <br /> outfall line can be made. <br /> Issues that will have resolved in the agreement are as follows: <br />
