CONDITIONS OF APPROVAL <br /> GX-93-4 <br /> Roger Bianchi <br /> Unless otherwise specified, all Conditions of Approval and Ordinance Requirements shall be <br /> complied with prior to commencement of grading and/or excavating. <br /> The approval will expire 18 months from the date of approval unless (1) all Conditions of Approval <br /> have been complied with, (2) all necessary permits have been secured and remain in force, and (3) <br /> all necessary permits from other agencies have been secured and remain In force. <br /> Those conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance Requirements. Ordinance Requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. The average finished grade elevation shall be no lower than 96.7 feet. (Development Title <br /> Section 9-1410.3{b}{4)) <br /> b. All Conditions of Approval shall be complied with and grading shall have commenced <br /> within 18 months of the date of approval of GX-93-4. Excavation and final rehabilitation <br /> of the site shall be completed within 18 months of the start of excavation. (Development <br /> Title Section 9-215.14) <br /> C. All private roads involved in an excavation shall be maintained so as to control the <br /> creation of dust. (Development Title Section 9-1410.3{a)) <br /> d. Provide certification of approval of proposed final grades from the South San Joaquin <br /> Irrigation District prior to authorization being given to commence the grading excavation. <br /> (Development Title Section 9-1410.3{b}{2)) <br /> e. Excavation operations shall not be carried on during the hours from 9:00 p.m. through <br /> 5:00 a.m., except during periods of declared national, state, or local emergency. <br /> (Development Title Section 9-1410.3{d)) <br /> I. All emissions shall be subject to the rules and regulations of the San Joaquin Valley <br /> Unified Air Pollution Control District. (Development Title Section 9-1410.3{f)) <br /> g. If noxious weeds are on the site, operations shall be in accordance with instructions from <br /> the Agricultural Commissioner of San Joaquin County. (Development Title Section 9- <br /> 1410.3{h)) <br /> h. Any night lighting established on the property shall be arranged and controlled so as not <br /> to illuminate public rights-of-way or adjacent properties. (Development Title Section 9- <br /> 1410.3{e)) <br /> I. Excavations shall not cause health or sanitary hazards and shall not create conditions <br /> which will cause the breeding or increase of mosquitos, rodents, or other pests. <br /> (Development Tale Section 9-1410.3{i}) <br /> Conditions of Approval - 1 - GX-93-4 <br />
