STAFF REPORT,Item 15 -5 <br />' CEASE AND DESIST ORDER AND CWC 13308 ORDER <br /> MUSCO OLIVE PRODUCTS AND THE STUDLEY COMPANY <br /> SAN JOAQUIN COUNTY <br /> make the facility improvements over the schedule provided in the C&A. Staff believe that this is more <br /> than sufficient. The Discharger has been on notice since May 2000 that it must make substantial <br /> improvements in its waste treatment and disposal system. As part of the C&A, the Discharger <br /> completed the technical reports describing the improvements it needs to make; Musco now needs to fully <br /> implement the recommendations in the reports. Finally, a July date allows the Discharger to wait until <br /> after the end of the wet season to complete construction activities. <br /> This C&D Order will remain in effect indefinitely, until the Board rescinds it. During that time, if the <br /> Discharger fails to comply with any aspect of WDRs No. 97-037, or any revision to these WDRs, then <br /> the Executive Officer may send a letter notifying the Discharger that it must cease discharge within ten <br /> days. Staff realize this is a very stringent requirement, and do not anticipate the Executive Officer would <br /> send such a letter for a minor infraction. However, the Discharger quite clearly wishes to significantly <br /> increase its production over the flow and loading limits in its current WDRs. Staff believe Musco will <br /> make the necessary improvements to manage its currently authorized flow and loading limits, but may <br /> later follow past practices and either expand beyond permitted limits or not be able to land apply its <br /> wastewater in a manner authorized by its WDRs. Therefore, this C&D should be effective for several <br /> years and through any future revision of the WDRs. <br /> Recommendation <br /> The Discharger's wastewater treatment and discharge system has proven to be inadequate and needs <br /> substantial modifications. Staff has attempted to work voluntarily with the Discharger, and when that <br /> was unsuccessful, attempted to resolve the issues through a Cleanup and Abatement Order. The <br /> improvements have not been completed and the Discharger is continuing to violate its WDRs and to <br /> increase its flow and loading rates beyond that allowed in its WDRs.
