V , <br /> Development committee <br /> Memorandum <br /> MS-92-120 <br /> Page 2 <br /> Section 9-3248 (e) (1) requires the applicant to submit a written <br /> request for a density bonus with the subdivision application. <br /> The applicant has not yet made that request in writing. <br /> This application cannot be approved until a written request for a <br /> density bonus is submitted to the Development Services Division. <br /> The maximum density allowed pursuant to this section in areas <br /> designated Low Density Residential is 7.5 dwellings per gross <br /> acre. This application meets that requirement. <br /> The Title requires guarantees for continued affordability of all <br /> lower income density bonus units for 30 years, or a longer period <br /> of time if required by the construction or mortgage financing <br /> assistance program, mortgage insurance program, or rental subsidy <br /> program. <br /> In addition, the developer is required to enter into a <br /> Development Agreement with the County to ensure compliance with <br /> the provisions of the Density Bonus Section of the Title. The <br /> requirement for a Development Agreement would be a condition of <br /> the tentative map. Development Agreement Regulations are <br /> provided for in Division 11 of the Title. The review procedure <br /> requires a public hearing before the Planning Commission. If the <br /> Commission recommends approval, then the item is heard by the <br /> Board of supervisors. A fee is required to process the <br /> Development Agreement. <br /> After the Density Bonus and lot width issues are resolved, the <br /> Development Services Division may attach the following <br /> conditions: <br /> Unless otherwise specified, all Conditions of Approval shall be � <br /> complied with prior to recording the Parcel Map. <br /> I <br /> Those conditions followed by a section number or other statutory <br /> requirement are based on ordinance requirements.
