The subdivider shall agree to and shall pay user fees for the utility services from the time the improvements are accepted by the County until the lots are placed on the County tax rolls, or up to an 18-month period, as the case may be. The applicant or the subsequent owner of the property will be responsible to ensure that there is capacity in the system at the time of a building permit. z. A State National Pollutant District Elimination System Construction Permit Notice of Intent shall be filed with the State Route Resources Control Board if over one acre of total ground is disturbed. aa. This subdivision, including streets, is subject to the County Storm Water Quality Control Criteria Plan, which requires treatment, filtration, or infiltration of the 85th percentile storm and post- construction Best Management Practices. NOTE: Any construction activity that results in the disturbance of at least one acre of soil shall require a State NPDES construction permit. 3.
