I: <br />remove from the Site the following Improvements as may have been installed within the <br />area subject to this Lease Agreement: <br />(i) above -ground equipment; <br />(ii) underground tanks; and <br />(iii) any soil contaminated by installation or operation of the Plant to the <br />extent necessary to comply with Applicable Laws. <br />Removal shall be in accordance with the then -applicable industry <br />i7 standards and Applicable Laws relating to the closure of the Plant. Removal shall <br />include modifications needed to restore the original functionality of County equipment, <br />including control features. Removal shall not cause violations of any Applicable Laws. <br />County may authorize Lessee to leave components in place that Lessee is otherwise <br />required to remove. All improvements not removed prior to the expiration of the <br />aforesaid ninety (90) day period shall, at Lessor's option, be deemed to have been <br />r� abandoned, and title to such Improvements shall vest in Lessor at the end of such <br />ninety (90) days, without any payment or other consideration given by Lessor to <br />" Lessee. Alternatively, Lessor may require Lessee to remove all or any part of such <br />Improvements at Lessee's expense and, if Lessee fails to remove such Improvements, <br />t Lessor may remove said improvements at Lessee's expense (but only to the extent <br />�! Lessee was required to remove such Improvements. Lessee shall in no event remove <br />any portion of the LFG Collection System without consent of Lessor regardless of date <br />of installation. Lessee shall not remove any equipment that existed prior to this <br />Agreement without consent of Lessor. <br />D. Lessor shall have the right, upon reasonable notice and during <br />normal business hours, to review Lessee's operations on the Site from time to time <br />77 during the Term. Such review and approval shall create no warranties to Lessee and <br />shall be limited to the extent necessary to satisfy Lessor that, in Lessor's reasonable <br />- judgment, Lessee is complying with the terms of this Site Lease Agreement and the <br />Landfill Gas Purchase Agreement, including, but not limited to ensuring that Lessee's <br />r Improvements and.operations on the Site: <br />(i) do not materially adversely affect Lessor, its agents, employees, <br />officers and directors or interfere with Lessor's operations of the Landfill; <br />(ii) do not emit noxious odors or other emissions which violate any law <br />or regulation; and <br />(iii) do not emit noise in violation of any law or regulation. <br />E.
